Hi,

I already understood all that, I said he will go on May to the US to retire, in order to retire you need to be living in the USA, so if he signs (looks like he will) than I´ll go

But you also said he'd only be returning for 1 year. Is he not planning to return to Brazil? Is he giving up his home in Brazil? Will he still be paying bills there?

Hi,

I really don´t know, he will retire in the US this year, the reason is that he has a house here in Brazil and one in the USA, he is registered as someone who lives in the US, so I don´t think thats a problem. If I go to the US, it will be to live with him or at least live in his house by myself.

The US citizen has to be in the US in order for you to have a green card through USCIS issued. As many here on VJ, the USC also live with their family members abroad while the process is ongoing and move back together once the visa is issued. I don't see any problem for you: If your father (since through a legal adoption, he is by law your father and not a stepfather) files for you today while he lives in Brazil, your petition will need a couple months to process anyway. When he moves back to the US in May he will be taking up domicile there. Problem solved.

It's amazing how many questions can be resolved with a 2 minute Google search...
