Finally got assigned a case number and IIN# today. I informed the lady that I'd had an address change. She stated she couldn't make any changes and asked me to call back in a few days. Has anyone ever run into such a thing? I also have an attorney helping with the application.

Not to beat a dead horse, but I'm seeing a lot of RFEs here for filling in the incorrect amount on income totals on the I-864, and I don't want to be the next one to take a tumble. I'm filing the I-864 as the sponsor; my husband will be filing the I-864A as a household member to include his income. We have our three most recent tax transcripts including 2013, and all MFJ. We each have an employment letter to show current income, as well as pay stubs. The last time I filled out one of these I used my AGI from my 1040 returns and had no problems, but it seems like that has changed. Please correct me if I have anything wrong here!

On I-864:

  • Part 6, Line 5 (current individual income) corresponds to the amount shown on my employment letter
  • Part 6, Line 6.c. (current income from household member) corresponds to the amount shown on my husband's employment letter
  • Part 6, Line 10 (current annual household income) is the sum of the two amounts in the employment letters
  • Part 6, Line 13.a-c (total income as reported to IRS) corresponds to Line 22 (total, NOT adjusted for 1040) on our joint tax returns

On I-864A:

  • Line 10 (current individual income) corresponds to the amount shown on husband's employment letter
  • Line 11 (total income as reported to IRS) corresponds to Line 22 (total, NOT adjusted for 1040) on our joint tax returns

Since my husband was self-employed he is automatically required to submit a copy of his 1099 and Schedule C, despite our submitting transcripts? And will I need to send in my W-2 forms to show my individual reported income since we filed jointly, or will that not be a problem since we are submitting the I-864A? Also do they require any evidence that their definition of "household member" for the I-864A applies to our case such as proof of living at the same address, or since we filed jointly is that taken for granted? You never know, better to ask now then to cry later.

My understanding is that if your divorce wasn't finalized and you're still legally married, the underlying marriage for your spousal petition isn't valid unsure.png Not sure I'm interpreting your meaning correctly with "closed" and "dismissed" though.

It was dismissed due to no show by both the parties. I don't understand when you say ' underlying marriage for your spousal petition'? I am a VAWA beneficiary which means I am self petitioning myself.

Yes, that's completely normal. I couldn't update with beneficiary's email address when I first got my case number and IIN because our case wasn't quite "ready" in the computer yet. Try again tomorrow or Wednesday and it should be fine.

I have a question about AOS, I am petitioning for my wife and my 2 years old daughter and since I have to separate I130 do I need to send (and pay) two separate AOS, also if I have to do that do I need to change any info on the I 864 (like the principle immigrant info part 2) I mean in one petition will be my wife and the other will be my daughter!!! confused,,,thanks

1. I ve been reading about DS3032 there. But we are not filling DS3032 now, right? So, replace all the DS3032 with DS260 and DS261?

2. And everything else is the same? We will still send in the OPTIN email for EP AFTER the AOS bill invoiced? And wait for a GOZ number after the GUZ number?

Ive been studying the Montreal page...but finally I ve come to the right page for Chinese beneficiary!!!! And after reading it, feeling a bit confused.

when you get your IIN and case# , ask if the petitions are joined together, if they are you'll only have to pay 1 AOS fee. are you a USC, if you are, you'll fill out i864w for your minor child.

we received an email response regarding our inquiry about our DS-261. our son got a right response to it but with my case their talking about the DS-260 form even though we haven't received our IV invoice so we're really not there yet, filling out DS-260. so I know its a wrong response, should we just disregard it or I need to call NVC just to make sure?

No, the AOS fee will cover both petitions for your wife and daughter. If they have each got a separate petition, you will fill out an I-864 for each and per the instructions on the I-864, you will not list wife/daughter on each others petitions.

when you get your IIN and case# , ask if the petitions are joined together, if they are you'll only have to pay 1 AOS fee. are you a USC, if you are, you'll fill out i864w for your minor child.

am I right that the i864w does not apply for my stepson since I haven't adopted him?

Now they will both be going through London :) Still waiting for the immigrant visa part and AOS is still not showing in their system as being mail received. I'm thinking they should get more mail room workers to help with the backlog too. The economy could be improved just by the creation of jobs at the NVC alone lol!

Glad to hear the numbers are sorted! Have you been calling to check up on AOS? I was planning on making my first call to check on it this Friday, and to see if I could wheedle some estimates for the IV invoice out of them as well. One week down (since DS-261), I'm hoping it won't be more than two more to go...

No, the AOS fee will cover both petitions for your wife and daughter. If they have each got a separate petition, you will fill out an I-864 for each and per the instructions on the I-864, you will not list wife/daughter on each others petitions.
