So who sends the documents for IV package and AOS package etc.? I had a lawyer do i130 for me and due to G28, there won't be DS 261 generated for me once I get approved. Do you recommend letting my lawyer send the docs on behalf of me? My concern is he is very busy and hence not as proactive as I would like him to be. Montreal allows EP so I am thinking to submit docs myself.

In my opinion, you should do it yourself. You can control how quickly you get the stuff done, no matter how dedicated the attorney they are not going to have the same sense of urgency as you. I've heard in some cases that they insist on doing it them selves, in that case I would go ahead and fire the attorney. There are some members who have done that. For all the questions you might have or the help you'll need you have this great VJ community to help.

Does the petitioner necessarily need to submit the police certificate when he/she sent the IV package to NVC. I thought the applicant will be informed by the embassy to take it during the interview? Please help me on this piece of puzzle. Thanks!

No the embassy will not be telling you anything. You won't get to the embassy until you are case complete at NVC. The Police Certificate is part of the IV package.

Unless you are from a country that the police certificate goes straight to the embassy (I think there are 1 or 2 countrires) its submitted with your other original documents. Of course all this is the beneficiaries information not the petitioner.

If you move before interview just take a new DS-260 to interview.

If you move before you are assigned interview your casefile is still at NVC and you can just update information with them. But I would also still have an updated DS-260 in hand for interview.

Also be sure to also update your petition information uscis.gov (remember the monitoring of your case than) this is vital cuz this is the information they go by to send you your green card.

We would like to believe they update everything but you never know. Long as information is correct with USCIS.gov site that's all that really matters.

You can or your lawyer can. No one says your lawyer has to do everything unless that's part of the contract.

Hi, I have an attorney as well but we have very good relationship and i explained to her that I have been waiting for over a year now for my spouse to come and that I will be sending the IV and AOS packets. It is just faster that way they can assist you with any questions but you know that you will take the most uber care of your work because you want it done asap wink.png

Hello everyone, I need to get a police clearance from a 2nd country that I lived from the age 16 - 25. I have to request from the Consulate in Montreal of the 2nd country for the police clearance. They need an address where the police clearance is going to be sent directly (it could take up to 4 weeks). I would like to minimize the waiting and I am wondering if I can request it already even if I didn't get yet a NVC #; and where it could be sent? Does it go to NVC or to the USA consulate? All the help that you could provide will be appreciated.

No the embassy will not be telling you anything. You won't get to the embassy until you are case complete at NVC. The Police Certificate is part of the IV package.

Its all done online. No signature. So have at it the Ds-261 and DS-260 is the beneficiaries but I am sure many a petitioners do it.

Thanks a lot again. I am close to the end of my question. Before accessing the DS-261, there is a box that asks you to select if you are a petitioner, applicant, attorney or third-party agent. So do I need to select applicant though I am a petitioner? I owe you big for replying all my questions. God bless you!
