but it was 3 questions that requires 1 answer.. will it affect my approval if i got denied from tourist visa?

My husband was also denied a tourist visa which we had to mention. We don't think it will affect the case negatively seeing as though he was denied because we were already married and they felt he was an immigration risk. The officer at the interview told him he need to apply for a spousal visa...which is what we are doing. So hopefully no problem.

Saylin,

I married my wife a Canadian in early 2013 , my interview will most likely be after April 14th, I filed my taxes in January as "single" if I filed as "married filing separate" it would have been the same amount but would take longer to receive my refund. The tax person added a note to my file stating this reason. So your saying amend, however why cant I amend 2013 once my wife gets her SSN?

How can you prove that it becomes a major red flag when they see this?

I Searched for people being rejected on this and haven't found anything

Anyone have any insight into my situation.

So, I received the following checklist today:

______1 - IMMIGRANT VISA APPLICATION PART 1:_______________________

The National Visa Center received your DS-260 form. We are waiting for the traveling applicants supporting civil documents to be submitted to the NVC. Your online Immigrant Visa Application will be reviewed upon receipt of your supporting documentation.

To view which documents the applicant must submit to the NVC, please go to our website immigrantvisas.state.gov.

______F - FINANCIAL EVIDENCE:______________________________________

The NVC has received the information you have submitted in reference to the Affidavit of Support. Please be advised that the Affidavit of Support information you have provided does not appear to meet the minimum income requirement according to the current poverty guidelines to sponsor the intending immigrant(s) for this petition. The consular officer will make a decision regarding this requirement at the time of your interview. In order to avoid delays, you may wish to submit an additional Affidavit of Support (Form I-864) for a/another Joint Sponsor to the National Visa Center to assist in sponsoring the intending immigrants. To view the current poverty guidelines, visit http://www.uscis.gov/files/form/I-864P.pdf.

If you decide to use a Joint Sponsor to assist in sponsoring the intending immigrants, please note that you the sponsor may not use Form I-864EZ and will also need to submit Form I-864.

My husband, the beneficiary, saw the email before I did and freaked out, and then I read over it and thanks to Saylin knew it was a false checklist because it didn't ask for anything specific. Anyhow, I called NVC (spoke to some guy named Bruce who was extremely rude), and asked about my IV packet, and he said we received it on the 21st please allow 30 business days to review. Then I asked about the AOS part of my checklist, and he said you are recommended to have a joint sponsor since your income is below poverty guidelines; I then mentioned my assets and he proceeded to say that assets do not hold much weight because I will need to show that I can put food on the table.

Here is my situation now, I thought I was fine, but I'm having a slight panic attack now - I'm currently a full-time student (have a BS and MA in Biology - now doing prerequisites to do a masters in nursing), I do have income from my investments (in 2013 they were around 13,500, and in 2014 they are projected at 14,000 - very low risk investments), I have over 800,000 in assets, some in checking and savings, some in a risk-free certificate of deposit, and around 550k in investments which are broken down into fixed income, equity, and bonds - again very safe investments. I showed proof that I acquired all this money back in 2005 after my dad passed away from a settlement, and the amount has only gotten higher, I essentially haven't touched the money - so for 9 years it's been growing. Technically my AOS has been Ok'ed by the NVC from what I understand, just the CO will make the final decision. Should I add along a joint sponsor? I personally don't think I need one, but don't want my husbands visa to be denied because I thought wrong.

Any help would greatly be appreciated! Thanks everyone and have a great weekend!

Is the DS-261 generally available before the aos is invoiced? I already paid the AOS fee and was hoping to send the AOS packet by Monday, but the DS-261 isn't available yet and according to NVC, they can't process my case until I complete it.

  • There is no need to change "single" status on Indian passport because usa gov does not care about it.
  • All them to give PCC as single
  • PCC will not have your marriage status
  • PCC will Not have your address
  • Hence the is no need to freak out on this

The PCC does not have this but he needs to add his wife's name using a reissued passport.

When you show them NOA2 - which has your relative's name on the petition - the staff at the PSK will force you to add her name.

Without his wife's name, there is no PCC.

No IV complete.

they're on seperate paths so no, the DS-261 had nothing to do with the AOS and vice versa.

You can send the AOS package if it shows paid.

Thanks! I know they're separate paths but in the email I received from NVC, they stated my case could not be processed without a completed DS-261 which is what confused me. Thank you so much, though!

Not to put a damper on your spirits, but I'm a Canada filer as well, and it's taking them almost the full 20 business days to review AOS & IV. (You can check my sig for info) I'm hoping for a May interview too.

Oh yeah for sure, I expect the aos/IV to take a month. I just hope for an end of May interview so he can move in June. A girl can hope ;)

Well it kind of can't because you need the DS-261 to be accepted to get the IV bill to be invoiced. They can do the AOS part but until the other part happens you're not able to send IV docs or do the DS-260.

Totally! It is easier to feel more positive on this side of NVC. I know we have all had such a loooong journey so far. I get excited to see people's progress. :)
