12/30/2012: Got engaged.
1/16/2013: Got married in India.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.
5/27/2014: Petitioner received response from NSCFollowup that the case was pending an internal extended review. Really?

Well yes and No. You would think a person would have a good 4 week jump on someone having a lawyer because no DS-261 so IV bill and AOS get invoiced together.

However toe to toe without you get through faster because lawyers don't call NVC (a rare few may). You will see people post all the time "Lawyer waiting for email or snail mail. ) I know someone who waited 8 months fr lawyer to get information because lawyer refused to give email at USCIS or NVC so everything was the mail. It took 6 months to get case# through mail. Then 2 months to get mail of AOS, and another 2 months for IV.

In all they were at NVC for 13 months when they finally got interview all because a hardheaded lawyer (they were too and wouldn't believe me that you can call the government). The lawyer told them their file would be pulled and denied. :protest:

Because we at VJ encourage and tell you to call you get to find out weeks ahead. Look how long it takes after you call and get case# to get the email. Someone gauged it and they said it is 6 months if you just sat around and waited for NVC to let you know the next step.

Thank God for Saylin and the rest of you knowledgeable people that keep us on track and give us a leg up and hey kick some knowledge to us that maybe we can help the next person that comes along. :luv:

Also, yesterday, our lawyer has dissolved our legal partnership (because we called NVC to get some updates without asking him first...). So we are on our own now! As we officially had a lawyer when the AOS and IV fees were invoiced, we did not complete the DS-261. We emailed NVC to remove our lawyer's name and declare my husband as the agent. No news yet from NVC.

Do you think we could have mess things up by paying already without official agent? Will we have to complete a DS261 and, if yes, should we wait for it to be accepted to send our packages?

Finally, random question : our "lawyer" once told us we should send more relationship proofs with the IV package. During our final call yesterday, he told me the contrary. I am confused..! So : no more proofs or more proofs??

I am seeing both the pros and cons of having a lawyer. I have seen many people fire their lawyers at this stage.

Yes, I think the W7 was included. A form was needed with my signature on it, I am guessing that's the one.

hi guys i need help on form i-864 part 5.my husband is sponsoring me and my 3 children,in 5.1 i will enter 1 right?then on 5.3 i will enter 0 and in 5.4 i will enter 3 so the total household in 5.8 is 5,am i correct?your reply is greatly appreciated.thanks

1. I know some of my old jobs have moved away and changed to new phone number, all I have is old address and old phone number which obviously won't work if you dial now. Is it ok to put them on there? That's all I ve got anyway.

Those doing EP only scan documents and send them via email, but they must bring originals to the Interview.

That's for those going through EP. That doesn't concern you; ignore it.

Yes, you can send packages together. If you read the wiki, I give an explanation of what I would do if I was sending in the two packages together.

Nothing needs to be changed. Just input your information as usual. Doesn't matter if NVC receives the package from within the US or abroad.

And added. I think you mean Nebraska and not NVC? :P

I thought the cover letter was only for those who mailed their documents to NVC, then I got it that those doing EP can also include a scanned cover letter. I went back and read what to do if sending the two packages together, thanks :thumbs: . About the nothing needs to be changed if the IV package is mailed by the petitioner, I remember someone asking about a couple of pages back and you telling them to make some changes, what changes and where I can't seem to remember. :oops: silly me, yes I have been approved from NSC and not NVC, though I wish, all three are so similar, NBC, NSC and NVC.

I am the UCS and I live in Australia with my husband where I have been employed for the last 2+ years. I have been filing/paying taxes in both countries for the duration.

Because I do not have a job in the USA I am using my parents as joint sponsors, they meet the income requirement but my Dad is self-employed and my Mom is contract labor.

How do I provide pay-stubs for my Dad and my Mom (if she is not a salaried employee)? Also, because my Dad is self-employed I won't have an employment letter for him showing income and position.

I have their passports, birth certificates, and 2012 Tax Returns.

Do I have to request originals of their Tax Return Transcripts?

Hi cscrum,

From the i-864 instructions relating to self-employment:

If you checked Item Number 2. in Part 6., (self-employed), you should have completed one of the following forms with your Federal income tax return: Schedule C (Profit or Loss from Business), Schedule D (Capital Gains), Schedule E (Supplemental Income or Loss) or Schedule F (Profit or Loss from Farming). You must include each and every Form 1040 Schedule, if any, that you filed with your Federal Tax Return

The instructions also note that you just need to provide either an IRS transcript or a photocopy from your own records of your Federal individual income tax return. You don't need to have them certified by the IRS unless you are specifically requested to do so by a Government official - a plain transcript or photocopy is acceptable. The instructions also state that if you do provide a photocopy of tax returns, you must provide a copy of each and every Form W-2 and Form 1099 that relates to the return. Those forms aren't required if you provide an IRS transcript of your returns rather than a photocopy.

Hope that helps. I've been reading up on the instructions myself this evening working out what tasks I can set myself to do at work tomorrow to get me through the day!

remember you shouldn't include any relative on part 3 of the form that is on separate visa petition. so if your husband is petitioning you and your children it should just be you on part 3 no. 1 and don't check the box part 3 no. 2 plsu don't put your children's name on part 3. that brings the part 3 line 7 of a total of 1 household and that's only you. remember to do the same thing too to every forms for your children. and if its a stepchildren of the petitioner, NVC look at it as they're not yet dependents of the petitioner.

Our case was received at NVC 02/18 and the case number was assigned last Friday, 03/21.

Yesterday (03/25) we were able to submit the payment online for the AOS and the IV. @Saylin, could you please update our info on the NVC Processing Time Spreadsheet? Thank you :)

Wow, i hope our lawyer doesn't get mad when i tell them i called NVC this morning. I just want to get the case number and have so far resisted the temptation to interfere. She has only talked to someone once so far- and got the 30 days thing.

Maybe i won't tell them i called if i don't get it. Also not sure if i do get it, if i should give over our emails, because our lawyer is doing all the paying of everything for us. ARG I'm still gonna phone though hah

Wow, i hope our lawyer doesn't get mad when i tell them i called NVC this morning. I just want to get the case number and have so far resisted the temptation to interfere. She has only talked to someone once so far- and got the 30 days thing.

Maybe i won't tell them i called if i don't get it.

They work for you buddy not the other way around.

Whomever terminated that guy's contract was just some overworked shyster.

I bet he wanted more money and realized he wasn't going to get any considering their case was probably straightforward.

You have every right to call the NVC.

You are more important than the "agent"

remember you shouldn't include any relative on part 3 of the form that is on separate visa petition. so if your husband is petitioning you and your children it should just be you on part 3 no. 1 and don't check the box part 3 no. 2 plsu don't put your children's name on part 3. that brings the part 3 line 7 of a total of 1 household and that's only you. remember to do the same thing too to every forms for your children. and if its a stepchildren of the petitioner, NVC look at it as they're not yet dependents of the petitioner.

Her post reads as if her husband is filing one petition. If that is indeed the case then they should be listed on part 3.

It would then be correct to include them in 5-1 as long as they are not listed on a separate visa petition.

This applies to all immigrants the husband is sponsoring who are immigrating within the 6 months of principal immigrant.
