Question regarding the I-864 (trying to be prepared!)... would it be worth including an additional page noting that although I have filed my US returns in 11/12/13, the income received will be non-recurring as it was earned in Australia? And that I will look to secure employment/income in the US on relocation? We satisfy the assets test and also have a sponsor just in case, so we shouldn't have any issues on that front. I'm just not sure if because my tax was filed as foreign income if I should include an explanation on it. I was considering sending copies of my Australian tax returns just to re-confirm the lodgement here and that I have actually paid tax. Is that overkill?

Hi Saylin I have a question about AOS. We will be using assets as both our incomes fall under the foreign exclusion amount even though my husband will still be employed by his Canadian company once he moves to the states. He is a commercial pilot and only works a couple blocks a month and will commute. Anyway the question is how much of our assets count? I thought I read somewhere 1/3 is that correct. I have read your threads 1 and 2 and do not see it addressed there. Thanks.

Yup, it's 1/3. So, for example, if you have $3000 worth of assets, for immigration purposes, it only counts as $1000.

I agree! EP is not really saving any time at NVC stage. But snail mail is really not an option for us. So for better or for worse, we are stuck in EP. And I have no timeline to compare for getting the GZO numbers and Gus couldnt even tell us how long...We ll just wait and see.

Thanks for asking! It went well :) Didn't do a whole lot this afternoon though as I was waiting for specific tasks to be assigned to me. I spent a lot of time staring at the computer in front of me, twiddling my thumbs. I was just itching to get onto my email and thus VisaJourney to answer everyone's questions :rofl:

Congratulations to all the case completes and thank you to all who posted. I noticed that many had sent in their documents around the same time we sent ours so curiosity got the better of me and I called NVC this morning...guess what case completed on 3/24!!! I'm so happy, I couldn't wait to get home and tell you all, no one else understands how happy each step forward makes us. I'm going to visit my husband on Friday (for a pre-planned trip), this news made my day!

Hi everyone

Finally got the case # 24th. DS-261 submitted and AOS fee paid. Planning to send the AOS package in a week time.

How long it will take before IV fee is available? I need to apply for police character certificates which will only be valid for 6 months..wondering what might be the best time to apply for those to stay within validity up to my interview..

I'd suggest applying for the PCC now if you've submitted the DS-261. The IV fee will be available within a couple of weeks.

I'm on this forum since October, and it's the best place to share visa experiences because when you talk with other people they're looking you weird, because they just can't understand what we're going thru. They can't even imagine.

It's so true. My friends and family all want to be sympathetic and supportive, but they'll never truly "get it." It's wonderful to be part of a group that can really empathize with no explanations needed. Being able to talk to people about the visa process without it turning into a lesson on federal immigration law is awesome!

It's so true. My friends and family all want to be sympathetic and supportive, but they'll never truly "get it." It's wonderful to be part of a group that can really empathize with no explanations needed. Being able to talk to people about the visa process without it turning into a lesson on federal immigration law is awesome!

Yes, and without judging that you talk only about that, and explaining why it took so long, and how other people centuries ago issued there visas soon... What should i talk about when my life is on hold for over a year!!! I'm beneficiary, I'm moving. hard, hard, but the thing is that i didn't have a clue how this going that's additional shock that i survived... but end is near let's be super positive :)

Most definitely! Feeling so optimistic these days, the finish line is finally in sight. It's incredible the difference between now and even just a month ago. While waiting for case number we were so worn out and dejected, now we're all hope and energy. It doesn't hurt we just had two weeks together to revitaliz :) I'm ready for a strong finish to the visa process!

Oh gosh! That's a whole new dimension of ####### to deal with. I can't stand when people go off on rants about illegals when they hear my husband is immigrating. I guess it's the only awareness of immigration they have, but they're not even close to the same thing! Fortunately Boston is a liberal city and I rarely get that reaction :/

I too am very thankful for this forum and for everything that VJ has taught me about this process. The worst part about it is that my husband lives in a small town, filled with, ahem, older people who are constantly going on about how in their day you just got married and that was it. Your spouse could come live with you in the US and it was perfectly legal. They don't understand how much the immigration process has changed. Even people from his work who have no idea about any of it are constantly filling his head with ####### that is not true about immigration. It sucks when he comes to me all hopeful because someone told him something I have to shoot it down with the truth.

Greetings All,

A question regarding EP file naming conventions – I have reviewed both the Wiki for Canadian Spouses in addition to the NVC’s info page in regard to sending EP packages, however a couple of questions remain. I understand that for the AOS package email, one will have a few files: cover letter, I-864 form, tax information, pay stub(s), and employment letter. Given that the AOS supporting documents pertain to the Petitioner would the file names reflect the Petitioner’s name or that of the Beneficiary? The NVC website provides the following example:

  • ABC2009123456_John_Doe_I864.pdf
  • ABC2009123456_Jane_Doe_Birth_Certificate.pdf

Which presumably suggests that dependent on the nature of the attachment, Petitioner and Beneficiary names are used interchangeably, is this correct or should all file names reflect the Beneficiary’s name?

This wait to get a case number is starting to wear on me... this is now really really depressing.

7 months to NOA2 and then BAM ! They put you in another purgatory for 2 months.

If you have a spouse working in India even on a different Passport I just realized I now have to wait 4 more months.

Tonight I received the false checklist Jim warned me was on the way last night. Is a false checklist any indication of when the review might actually take place? Anyone here who's received one for the IV packet, when did you get it approved? My optimism is getting the better of me and I'm wondering if having received the checklist is a sign that our form is actually ready for review. Someone bring me back down to earth please!

I got a false checklist tonight too! Calling again to make sure, because I don't trust just one answer from them. :P

Same here. Mine has been yellow since yesterday evening and today I got an email to pay but that yellow triangle is just pissing me off now. Cant pay as of yet.
