NVC Filers - March 2014

Hey Saylin

I hope the new job is going well!

So, we spoke to a NVC rep yesterday who said our case was complete! She then said that although it is complete, there is one correction that needs to be made but I will need to take this to the interview and not need to send it in as a checklist response to NVC.

We just received an email from NVC that is exactly like a normal checklist. It has the bar code cover sheet etc and is titled CHECKLIST. However, on page 3 it says this...

We have finished reviewing your case. We will tell you when we set an interview

date for your case. Please do not contact the U.S. Embassy or Consulate in
LONDON, GREAT BRITAIN AND NORTHERN IRELAND about your
interview until we give you the date.
We saw that either your Affidavit of Support was incomplete, some of your
supporting documents were missing, or both. We have marked the missing items
on the checklist below.
You should send any of the missing items to ************** so he or she can
take them to the visa interview. The Consular Officer will review the missing
items at the time of the interview.
The checklist is because my wife did not put N/A in a box (sponsors place of residence if different from mailing address. Can we safely assume that the phone rep from yesterday was correct and our case is indeed complete and we just need to prepare a new form with the N/A included for the interview.
Have you ever heard of them sending out a checklist to be addressed at the interview as opposed to sending the info in?
It was just the format of the email that through us off, because it resembled a normal checklist, plus it says this on page 4 when explaning the missing information...
NVC has reviewed the financial evidence submitted. However, additional information is
required to complete the financial evidence review. Please provide all requested documents and
refer to page two for mailing instructions
But my thinking is that this is just a standard template they use and that the fact that we have already correctly responded to a checklist and this one is very minor and not mentioned in our first checklist means they are happy for us to progress...
Many thanks in advance!

I only start my new job tomorrow ;) But thanks though!

Yes, what you received would confirm the operator was right. I have seen this before where a case is completed but there's a small error (aka checklist) that can be brought to the interview instead of sending the correction to NVC. Consider yourself lucky as this way you won't waste another few weeks waiting for NVC to review a checklist.

Hi Saylin,

Finally case completed as of March 22, I'll update my signature once I get home today.

Congrats! Updated the spreadsheet :)

Hi,

I am sorry to post this here, but I don't know where else to post this question(can't seem to find any threads about RFEs?):

NOA 1 date: 5/16/13

Transfer to NSC: 12/26/13

RFE: 3/10/14

RFE response: 3/18/14

RFE response review notice: 3/24/14

I am curious how long it will take from the "response review notice" until we get an approval.

Also, a question for any Japanese filers:

They asked for the koseki shohon. Since that means the "family register" and not the large marriage certificate we received, I was wondering why they asked for that? My husband had to go to the ward office and they refused to give it to him at first saying there must be some mistake and the USCIS was actually requesting the koseki tohon. It was really confusing and frustrating.

I translated the document myself, which I hope will not be a problem...after all this waiting I felt I could do it on my own and it would be a waste of time to have a company do it for us...I hope this wasn't a mistake. If you are truly married there should be no denial, right? After all this time though I feel like anything could happen, and it is making me nervous. If anyone has some knowledge on the subject, it would be greatly appreciated here!

Thanks!

This thread is for those with approved I-130 petitions. I suggest you look for and join the I-130 filers for May 2013. They should be able to help you out :)

How long does it take to get IRS transcript by mail?

Why not get it instantly online?

Before the online option was available, when we ordered transcripts through the mail, we typically received them within 2 weeks or so. But, now that it's tax season, it could take a bit longer.

Saylin I have one question for you… I’m in doubt with days…or anyone that have suggestion

About birth and marriage certificates… We submitted in USCIS international ones and receive RFE that document are not translated… It was misunderstanding my husband resolve that with USCIS in Chicago and they were accepted in Texas. The documents are according Hug convention.

I have new ones because according low in my country they mustn't be older than 6 months.

I want to send international ones because we applied in USCIS with international, but also I want to send on native language with translation because of the previous bed experience.

I’m in doubt now should I send international ones, or on native language with translations or both variants? What you think? and in cover letter to shortly explain that.

If you have both available, I'd say send both, just in case.

Hi Saylin! I need your help on our AOS checklist. I found out my husband didn't submit the transcript just the W-2 of 2012, 2011, 2010. But in our checklist they didn't mention directly that we have to submit it but just to complete part 3 and 5, am I right? I am confused actually coz my husband told me we don't need it. He said they didn't ask for it. So he said he will just send the same package with the filled up form I-864EZ. In the form, put N/A in part 3 and do the correction on part 5, which is just a couple of cents difference. What do you think Saylin? I would love to hear your opinion regarding this matter. Thank you! Btw, kindly see the message below from NVC.

F - FINANCIAL EVIDENCE:______________________________________ A review of the I-864, I-864EZ, I-864W or I-864A (if applicable) Affidavit of Support form and supporting documents that you submitted has revealed that you have provided incomplete information in your response or you have not responded to some questions.

Please pay specific attention to the questions marked in the attached I-864/A checklist. You will need to complete and submit a new form with the changes noted on the attached checklist.

You will need to follow the instructions for the Affidavit of Support (I-864) that are posted on the Department of State website at the following address: www.ImmigrantVisas.state.gov. From there, you can fill out a new form online, print the new completed form and mail it to NVC. If you are the Petitioner, please read all instructions and complete the correct form to submit to NVC. An Affidavit of Support form is required to be submitted from the Petitioner on each case regardless of his/her income level.

NVC will hold this case until you send us these needed items. When you return the documents to NVC, please make sure that the documents submitted are in the correct order and stapled together, as stated in the I-864 Important Notice instructions.

When responding to the National Visa Center, please include the bar code sheet that came with this letter. Failure to include the bar code sheet may cause a delay in the processing of your case. The bar code sheet should be placed on top of all documents being submitted for this case and mailed to the address provided.

NVC has reviewed the financial evidence submitted. However, additional information is required to complete the financial evidence review. Please provide all requested documents and refer to page two for mailing instructions.

General Instructions

[x] You will need to complete and submit the new form, completely filled out (all pages required), which includes the changes noted below. Submitting single pages of the form with the correction is not acceptable. In order to make corrections you will need to download a new form at www.ImmigrantVisas.state.gov. P

Part 3 Information on the Sponsor [x]This section is incomplete, please answer all questions completely. (If a question is not applicable, please indicate N/A in the appropriate space.)

Part 5 Sponsor's Income and Employment [x]____D*****_______________________________ 's income indicated on the I-864EZ Part 19 does not correspond to that shown on the most recent tax return and W-2(s).

For checklists, you don't fix the errors and re-send the entire package. You just send the corrections. So, according to this checklist, you just need to fix the I-864 form and send that. No need to include everything else. But, if you only sent W2s, and no 1040s, 1099s, schedules, worksheets, etc, then I would suggest he do that, or, even better, send the tax transcripts. I'm incredibly surprised you weren't checklisted for that...

Thanks. I did not get an auto reply, should I send another ENROLL email to NVC or if I call them will they know anything?

You could try calling them - they may or may not be able to let you know. Personally I would just send another enroll email. But I tend to overkill on documentation so.... Yeah ;) maybe call , see what they say and go from there.

Let me know what they say/how it turns out!

Awesome!!!! Super happy for you - I knew it would be soon! :)

Double good news! AOS was reviewed and IV packet scanned in, both just today. I got super helpful Jim on the phone this time and he warned me a false checklist was on its way so that I can disregard.

Yay!! That is really cool he let you know what's up. From my experience, the people at NVC have been so much more helpful. USCIS should get trained by these guys!

Im interested to know something , it would be great if someone knew the answer on it :-) :

About calling NVC- when we call them, the line always says it is busy and then hang up....hm...is it usual for NVC to be that busy ? we were calling several times during a day and could not connect to talk with someone there....it is also 1st time we call and im not sure why it always says it is busy....we called NVC phone number....

I also wonder - is it same when call DOS phone number? maybe they will know info about our case too....

Thanks

Greetings

IV fee line shows a Yellow Triangle and "Not Paid" status but if we click 'Pay" tab it takes us to next page and can't pay IV as the SELECT column not available.

Is it just us or a common thing?

When is IV invoiced? Do we receive an invoice email?
