Timeline
1. You are the person who filed or is filing the Form I-130, Petition for Alien Relative, for a relative being sponsored;
2. The relative you are sponsoring is the only person listed on the Form I-130 petition;
3. The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s).
If you meet the above criteria, then yes, you can file the I-864EZ with your 1040 IRS Form. That's exactly what my husband did, he filed 1040 in 2013, 2012 and 2011 (your case). We used Total Income (this applies to you). The Adjusted Gross Income is just for people using 1040EZ (not your case).

Awesome. And thanks, Very much helpful. This is exactly what I am going to do now.

APPROVED at the USCIS 3/18. Just got emails stating both cases have been shipped to the NVC. 3/21

I have to say.. I am surprised they were shipped so soon. It has to be the fastest action so far !!

lol true ..... but shipping out of USCIS is not the problem but actually getting to NVC and from there being uploaded into their system ....thats the worst part. its really taking them about 25 business days. And thats means with weekends and holidays and what not ... you are looking at atelast month and a half .... lol. Talk about being quick.

The ds230 is obsolete. They no longer use this form. You must go online and fill out the ds260. The only thing you need to send with your IV documents is the bar coded cover sheet that comes available when you pay the IV fee. As far as the AOS packet, you need to fill out the I 864 and send the bar coded cover sheet that became available when you paid the AOS fee. Nice to see you! I was wondering what happened to you. Good luck my friend!!!! smile.png

Thank you for your helpful reply. I see from your timeline you are almost through NVC too. All the best for the rest of your journey!

What!!! Just got an email from NVC. AOS bill ready to pay and fill in DS 261. Was told yesterday this will take 2 weeks, just got IIN yesterday too! LoveMyTico, what do you think? Confused.com.

Same thing happened to us. So we started with CR-1, because we didn't want to waste time any more, but we still did't hear anything from Embassy. As I can see you have medical scheduled smile.png)) I don't know call the Embassy and ask, I don't know

:))) See my signature. On March 4 my husband received post mail from NVC that our I129F for wife is shipped to Embassy in Skopje, since than we're waiting from them to call me, but in mean time we received mail from NVC with case number, IIN, beneficiary ID, so we started with CR 1. When they call me I will ask them what to do next. :)

No, but it's a waste of money. If you're going with the 129 you will have to pay the $240 fee. You shouldn't have started to pay the fees until you're sure you're not going with the 129.

Unfortunaetly you will not be told why. You will get the run around and it could take weeks to months. I have a friend who went through this last year.

She was actually waiting for case complete at NVC and their petition was requested back at USCIS. It took from September to December to finally get her petition back to NVC. And guess what all her documents the ORIGINALS her AOS her IV package all gone. So she had to start all over taking months she finally got case complete in February and got a April interview and all turned out okay. They just lost alot of time.

When she called USCIS they said nothing. Many speculated it could be a missing paper USCIS forgot to attach (Highly unlikely).

Really sorry all you can do is stay on top of it keep calling and keep an eye on your petition and i pray you have a duplicate copy just in case.

Thanks for this information.

I thought I am the one only who get this mess from USciS.

I don't know what that mean, if we paid AOS, I129F stops?

You can't do both but if you go K-3 the I-130 sits at the NVC for a year. So if the K3 fails you still have the I130. Just pay the fees

When I called NVC today, I was told my response to AOS checklist (received by NVC on 3/3) has been reviewed and accepted. Now waiting for the review of IV supporting documents (received by NVC on 3/10 and scanned by NVC on 3/13).

Shortly after my call, received the following false check list by email:

"The National Visa Center received your DS-260 form. We are waiting for the traveling applicants supporting civil documents to be submitted to the NVC. Your online Immigrant Visa Application will be reviewed upon receipt of your supporting documentation."

What kind of sadists run this process? Every time they review a document do they have to generate a check list (sometimes real, sometimes false)to keep us guessing?
