Unless you have a lawyer (in which the two fees are invoiced at the same time), the AOS will always be invoiced first since the IV fee is dependent on the DS-261 being accepted and added to the case file.

You can certainly send the packages together. But, there's no need to wait on paying bills. Pay them as soon as possible, in case there's a delay with one.

Okay so pay ASAP. But is it just as fast to wait for IV to be invoiced and paid then send the packets together as sending them individually as they become available?

Well, the benefit of sending the AOS package as soon as you can (which can be a few weeks before you can send the IV package) is that it'll be reviewed that much sooner. So, if for whatever reason you get a checklist, you'll have that much longer to respond to it. Compared to if you had waited to send it with the IV package. Personally, unless money is a big deal, I'd send the AOS package as soon as you can, just in case. But, that's simply my opinion ;)

Alright we'll send it ASAP! Money isn't a huge issue and if it could even slightly affect the speed of being approved I'll send it off. I just want my husband to get that freaking visa! It's been too long :)

For 2, looking at what it says, you would think you wouldn't mention the other parent (as they have their own petition), but when you get to the household size, like you mentioned, 3 doesn't sound right. Perhaps in your case, it'd be best to fill out 2 with the other parent's info, then fill in the household section with 4. Hopefully, that won't generate a checklist. Sorry I couldn't be definitive on this one laughing.gif

Thank You Saylin. It is very confusing but I have been reading online and it seems like I shouldn't be including the other parent while filling out I - 864 for the one parent. Read some replies from lawyers on other websites. Unless it's children accompanying parents .... Which is what I think their logic is ..... If only they can make it much easier to understand. Each person having a separate petition is considered a separate individual for the purpose of I-864. So let's say God forbid one of the visas or I -864 don't get approved, the other person or individual is still considered as part if household. I know it's like ... Can you make it any harder to understand.

Ok, what seems to be the problem here? The DS-261 is un-available. I sign in and get noda. looking at others signatures, it seems that they could fill out ds-261 the day they got case # or the day after? Hmmmm. I'm just curious cuz the cranky operator I got yesterday said that nothing would appear of happen for/with our case for 20-30 business days...no ds-261, no invoices, no bills, no nothing. Why would she say that? Has me a bit worried.

You can get the latest I-864 form from USCIS's website. There is no expiration date. Until a new form is released, you use the current edition.

You need to give it some time. It's been less than one full business day for you :P

the plan is to pursue the K-3. I already waited so long, I am not in the mood to wait at the NVC. Hopefully the K3 gets a case number and flies to CR before they even know my I-130 exists at the NVC. I couldn't care less about the adjustment fee when he gets here. I'm more concerned about the lost time and the time I still have to wait for the waiver ( that we can't even file til after his interview) I'm no spring chicken. Time is a ticking !!

of course that is only a "plan" nothing ever works the way you want it when you are dealing with Immigration.

That's their usual time frame for everything, and it's essentially just to cover their behinds in case it for some reason takes longer. I'd say by the end of the week, you should see some kind of action on your case!

sorry to bust your bubble but K-3 gets administratively closed once CR1/IR1 reaches NVC.

I am pretty sure. Maybe others will not agree with me.
