Hi guys! Called NVC today, they received my case on March 12.. Yaaaayy!!!

Hi Saylin, i'm thinking of getting my brother as my co-sponsor. He's income is good for 6 people for poverty guideline. But the problem is he's been paying child support before and he was behind with his payment i dont know for how many years. Then his ex-gf stop the case for a while, but he's still giving money for the child even without the case. Now the ex-gf decided to open the case again. My brother already sent all the paperworks for the childsupport but no decision has been made yet of how much childsupport he'll be paying every paycheck. My question is,is it possible to get him as my co-sponsor even if he's paying child support? He filed for our mother 4yrs ago,and our mom is already here with us.but when he filed for her before there is no on going childsupport case. Thank u in advance for your reply..

Thanks Saylin!!

We have been married for under 2 years, but I did find it weird that he spoke about the $985. I think he's trying to make money off of me since I did the I-130 by myself and had most of my documentation ready for the AOS and IV. I had even sent in the DS-261 and had paid the AOS fee prior. He even told me that he didn't need to charge the full amount since I had done half of the work.

I appreciate your help!!

Updated! Thanks for letting me know.

Thank you! Don't know why, but it's made me giddy XD

1. Well, it's taking around 15 or so business days to review packages. Once both are accepted, then the case is completed. Time frames from case complete to interview vary by country. You can do your own research for the DR on that here: http://www.visajourney.com/timeline/k1list.php?cfl=0&op1=3&op2=d&op3=5&op4=1&op5=5,6,8,10,11,13,14,15,16,17,18,20,21,22,25,26,27,28,108,110,111,208,210,211&op6=All&op66=All&op7=Dominican%20Republic&dfile=No&adv=

2. There is no $985 fee for IR-1/CR-1 applicants. You don't do AOS (adjustment of status). I'd be extremely wary of your lawyer if he's talking about this. There will be a ROC (removal of conditions) process in 2 years from POE (if you've been married under 2 years), but that's only about $600.

Doesn't matter who the joint sponsor is; it could be a random person you meet at a bar for all they care. As long as they're a US citizen/resident and over the age of 18.

Although pay stubs and an employment letter are technically optional, NVC may still request them in a checklist, so be careful. But, if he's been at the same job for that long, the chances are higher it won't be requested.

As far as I know, child support doesn't matter, as long as he makes earns enough for the household size.

Anyone here with a case number that starts 2014-571-XXX? We can track our case by this.. ever heard the nvc case number calculator?

The 3 digits after the 2014, in your case 571, signifies the day the case was assigned. One of the wiki's from VJ provided the info

++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++

This marries the USCIS receipt number to your newly generated NVC number which is based on

EEEYYYYOOOSSS

  • E = 3 digit embassy code (example TKY for Tokyo)
  • Y = 4 digit code for year (example 2008)
  • O= 3 digit code for Ordinal date plus 500
  • Example I. Aug 28 = 241st ordinal day ADD 500 = 741
  • Example II. 741 SUBTRACT 500 = 241st ordinal day (Aug. 28)
  • S = Sequence number of the day (if you were the second approval scanned, your code would be 002)

Full Example of NVC case number = TKY2008741002

+++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++
You can get the ordinal day at: http://www.atmos.anl.gov/ANLMET/OrdinalDay.txt
Day 71 in your case.. so your case was created on Mar 11th.

Some more AOS help needed!

My wife is the USC, and I'm in Pakistan. She has recently filed her 2013 tax return as a single. She didn't have income for 2013 as she wasn't in the United States from Jan to Dec 2013. She came back to US in December 2013 and has started working since Feb 2014.

Now I read in the FAQs that one cannot file single if they are married even if their spouse has never set foot in the US.

Am I understanding it correctly? Does she need to file as married????

It would have been better if your mother had filed an I-864, but whatever. As to your question, they should only require stuff from your father if you and your mother's income is insufficient.

Yes, she should have filed as married. As I stated in the bottom of the FAQ, you can't file as single while married. Not only can you get in trouble with the IRS, but it can be a major red flag at the embassy. I'd suggest amending the tax returns ASAP.

Thanks so much, Saylin. I've asked her to get this amended ASAP. Also, she told me that she filed her taxes as a dependent on her parents. Will it still be possible to change her status to married?

I just called NVC regarding copies of translations for my marriage certificate and the lady told me to not even worry about a marriage cert translation because my marriage was in Senegal, the interview will be in Senegal, and the document is in French, which is the national language. That saves me a bit of time and money. Maybe I'll add the copy of the translation just in case. I might call a few more times to talk to different people and verify, but I hope that answer helps others who might have the same question!

I am the petitioner (USC). My husband is Senegalese.

Hello everyone! I'm a long time lurker and love all the great info thank you everyone for the great information. And a special Big thank you to Saylin!

I'm very confused about the AOS-package. I'm the benefitionary and we have lived away from the U.S for almost 10 years. We have also been married for that whole time. We have no income in the U.S, but easily we have sufficient income to

fill the AOS requirements. Do we still need a cosponsor?

Greatly appreciate all your help.

It would have been better if your mother had filed an I-864, but whatever. As to your question, they should only require stuff from your father if you and your mother's income is insufficient.

I was about to file I-864 for my mother too. But then i saw this statement "If the additional sponsor lives in the same household as the petitioner, he/she is considered a household member, and cannot fill out a separate I-864. The household member must execute an I-864A" written on the DOS website's Review Additional Embassy/Consulate PDF instructions.

I got my question because from this post :(

I had an interview today and my visa is approved.

Thank you for all of your help and advice.

I don't know how I could go through this by myself.

I had a joint sponsor (father in law) to fulfill the AOS requirement.

His income was enough for the poverty line so his wife (mother in law) did not believe I needed her I-864A even though they filed tax joint because the instruction said no need to fill I864A if the joint sponsor has enough income.

I convinced her to send me her I864A so that I can show it at the embassy if they ask me, just in case.

And they did told me that I needed her I864A since they filed tax joint.

If I did not find VJ, I never knew they require I864A for my case.

It was not easy, but it would have been harder without VJ and VJ members!

Timeline

The 3 digits after the 2014, in your case 571, signifies the day the case was assigned. One of the wiki's from VJ provided the info

++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++

+++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++++

You can get the ordinal day at: http://www.atmos.anl.gov/ANLMET/OrdinalDay.txt

Day 71 in your case.. so your case was created on Mar 11th.

Oh, this is so cool! Thank you! You just helped me figure out the day our number was assigned (didn't know before). I did come up with a different date, though. We're also 571, but I came up with March 12... Any idea why the difference? Thank you.
