Hi! This process can be really complex and overwhelming at first. I don't know how many times I had to read it and write it down for myself to just get the overall picture! After I got the big picture, my approach has been to focus on each step at a time - I'm not a good multitasker smile.png

hi saylin,

i hope all is well. My case was completed and now just waiting for it to get shipped to the Consulate and the interview date.

i know i have to remain employed with my current employer till her interview. Does that mean i can put in my 2 weeks resignation notice after the visa is approved?

I want to go visit and see my wife, visit her family, perhaps travel to a different country for a week then come back to the States together.

Same thing for me on my AOS. Since its been more than 5 business days, I suggest you call NVC and report back, as I'd like to know what they tell you. smile.png

I called this morning at 9 and they told me they would make a note to fix it in the computer because it should say paid. I'm going to call again when I get out of work and just make sure the note was made because I think my checklist is being held up because of this now. :(

The case is only shipped to the consulate/embassy AFTER an interview date is scheduled.

And I suppose that's okay, but how do you expect to support your wife with no job?

Saylin, please add my AOS Sent date to the spreadsheet. (March 7, 2014) (Also, my approval came from Nebraska, not the NBC. I'm not sure why my transfer isn't showing up on my timeline.)

Added! And yeah, we found out a few days ago the timelines unfortunately don't show transfers :( Thanks for letting me know though. I'm sure a lot of the service centers on the spreadsheet are wrong due to this fact.

Regarding AOS

My wife got permanent Job on SEP 2013 with an annual pay of $ 50,000. Hence 2013 tax transcripts show annual income of 11000 only (obviously pay accounted is SEP 2013 to DEC 2013). However, she has letter from employer clearly indicating her income of $ 50K. Also we will be sending her pay stubs from SEP 2013 till date (6 months).

Will this be fine?. I was afraid as her latest 2013 tax transcript shows $11000 as annual income. But this is obvious.

Please guide

Because this is her first job and has no previous income, it might be a good idea to have a joint sponsor. Yes, her current income is more than enough, but looking at previous years (2 of which she was unemployed, the most recent only starting in September), she's obviously under the poverty lines. And since they do take previous years into consideration, it'd probably be safest if there was a joint sponsor. You can always send the AOS package without one and see what NVC says. You might pass with them. But I'm thinking at the interview at least, a joint sponsor will be required.

My wife came in Europe, Georgia, Tbilisi in April 13 of 2013 and after 3 month we got married, since her arrival we live together. Despite of short period must she (My petitioner) prove US domicile? (I have heard at another forums that if it is 1-2 year you don't need to prove domicile, but i am expecting confirmation form you anyways) Thanks

Is the petitioner LIVING there? If so, then yes, I believe domicile needs to be proved.

Guys, am I correct in concluding that we may file I-864EZ for AOS purposes if my husband is the U.S. petitioner, I am his only beneficiary (wife = relative?) and his sponsorship of me is based solely on his salary? Thanks!

If you meet all 3 criteria, then yes, you're eligible to file it.

Personally, in my opinion, no, because how I read it, the petitioner doesn't meet the third criteria of qualifying on their own income.

For employment, gaps are fine. It's just residence where there can't be gaps.

2013: July 20: I-130 sent (Chicago lockbox)

July 24: I-130 NOA1

July 24: I-129F sent (Dallas Lockbox)

Aug 2: I-129F NOA1

Aug 12: Alien Registration Number was changed, I-129F.

2014: Jan 28/29/30: - 3 transfer notices for I-130 and I-129F.

Feb 3 - Hard copy arrived -Notice of transfer to Texas stating Jan 29th.

Feb 10 - NOA2

Feb 27 - email stating I-130 being sent to NVC from TSC.

March 6 -NVC received our case.
