MFJ requires an ITIN or SSN. MFS only requires NRA in the SSN spot. BOTH require you to postal mail the return.

What about her signature in MFJ and MFS?

I think it's going to be the first week in April. Maybe the 3rd or 4th. Sooner would be better but I'm trying to be realistic. And by looking at other peoples dates that is my calculation. Good luck to us!!!! :)

Follow up question on the EZ- I will not use a sponsor, I'm using assets for AOS because I have foreign income. Could I qualify? I notice it says "income" not assets.

Unfortunately you don't meet the third requirement for the I-864EZ form :(

On the form instructions it states:

"You may use Form I-864EZ IF ALL the following conditions apply:

1. You are the one filing I130 (I'm paraphrasing)

2. You're sponsoring only 1 relative (paraphrasing again)

3. "The income you are using to qualify is based entirely on your salary or pension and is shown on one or more Forms W-2 provided by your employer(s) or former employer(s)"

So, it's about your salary/pension, can't use assests for this form.

My lawyer told me once our EP is accepted and got new GZO#, we can Email our packages.

What is special about our case:

We hired a lawyer and signed G-28 form, then DS-261 is not needed, possible the reason that we both AOS and IV fees are available today.

Hey Sashy,

You never mentioned you got an email auto response from NVC when you sent your AOS. I swear this process is making me loony. Is this right? OK so let me ask again? So you got an automated response first. Then you got a response in 19 days? is this correct? I never got an automated email after I sent it.

Yup! So first you get:

"

Thank you for your recent inquiry to the National Visa Center (NVC). This e-mail is an auto response. Please do not respond.

We review and reply to e-mails in the order they are received."

Then when they log it you get:

"Dear Sir/Madam:

The National Visa Center (NVC) received your inquiry regarding the immigrant visa petition: MTLXXXXX filed by XXXXX on behalf of XXXXX

We received electronic documentation for this case. Please allow up to 20 business days from the day the email was sent for the scanned attachments to be uploaded to the electronic case file and reviewed.

"

I never mentioned auto responses bc they are literally auto :P. Like in under 2 mins of sending it lol.

I called nvc on Monday 3/10 and the rep told me it takes 30 days! Thank god I called today and the lady told me the case was completed on 3/11!! My eyes got all watery when she told me that!!

It was strange that I received the false checklist on 3/10 and case was completed the next day.

She couldn't tell me when the interview date but the case will be shipped out soon.

So I know it's for choice of agent, but what exactly is an agent? We don't have a lawyer, so it'll be either me or the husband for sure. But does it affect where things like the interview package get mailed out or who they contact? We'll be doing EP anyway, so does it make any difference at all?

So I know it's for choice of agent, but what exactly is an agent? We don't have a lawyer, so it'll be either me or the husband for sure. But does it affect where things like the interview package get mailed out or who they contact? We'll be doing EP anyway, so does it make any difference at all?

An agent is just someone who will receive correspondence basically. Doesn't really matter who you choose because, if you give over both email addresses to an operator once a case number is assigned, then both parties will receive correspondence. It's really a pointless form at this point and should just be gotten rid of.

I need some advice from those of you who have filed their taxes as Married Filing Separately (MFS). Did anyone have issues in the Social Security section when they wrote in NRA for Non-Resident Alien? I just spoke to my tax lady and when she said that she tried doing my "taxes on the computer" that it just kept asking for a Social so she had to file me as single. I explained to her that filing as single is not an option as I am married and that will raise a red flag. protest6wz.gif

Did anyone have a similar experience or can anyone offer any advice? Thank you so much in advance. smile.png

ps: Just called NVC for an update on a case number and the lady wasn't very nice. unsure.png Guess they can't all be super nice.

We already finished tax papers. My husband submitted as MFS. He has put NRA in SSN section. We had no pblm. Evrything done Now papers are here with us and lined up for AOS.
