There is a tax section on VJ but as mentioned earlier I filed as married filing separate. I live in California which is one of the states that has community property laws which makes things more complicated. Since I haven't lived with my spouse more than 6 months I dont have to count her assets as community property. When you file with a NRA spouse who has no social security number you may have to print the forms to write "NRA" in the SSN section. You will do this on turbotax for sure but apparently there are other programs out there that will let you do this electronically. If you wish to file jointly then there is a seperate process of which I am not familiar with.

Legally you are required to file as married and not single. Whether the IRS finds out you are actually married is another story. I got married in central america to a canadian woman so there really isnt a way for the IRS to know I am married unless I tell them but I still followed the rules.

Thank you very much for your reply. What is NRA? If you married a person who lives in Canada or Mexico, you can do that but for the other places the IRS didn't mention it. I will contact the IRS local office tomorrow. If possible I will file as married just to avoid complicated stuffs.

File as MFS for now, then amend to MFJ once your spouse has immigrated and has gotten a SSN.

Thank you very much for your reply. What is NRA? If you married a person who lives in Canada or Mexico, you can do that but for the other places the IRS didn't mention it. I will contact the IRS local office tomorrow. If possible I will file as married just to avoid complicated stuffs.

NRA is the National Riffle Association. Just kidding. It stands for Non-Resident Alien. That first bit about the riffles was a joke towards myself as I despise abbreviations and I cant believe I used one without putting what it stands for in parenthasis, I am usually really good about remembering to do that so I apologize.

During my research on TurboTax I never noticed anything about it being a condition on which country the spouse is from. It simply stated if you are married to a non-resident alien then put NRA in the social security section and mail it in.

It took us 8 weeks to get our case number from the time NVC received the paperwork ....March seems to be slow from what I can see compared to Feb. I see peoples timelines from feb that received an IV bill only a week after their AOS bill! Lucky lucky....

Congratulations! You may want to consider to send Electronic Processing request as my lawyer already sent for me yesterday.

I read Ryan H's tread and also Darnell's wiki on EP in China, both are suggesting to wait until the AOS is invoiced then send in the ENROLL email as many have encountered problems sending them early, so we decided to wait till then. We are just sooo afraid to slow down this process furthermore. We didnt hire a lawyer. I guess it's different if you have one.

They are working over time and on Saturday to clear the backlog so just try to think positive.It took us 20 business days to be exact to have a case # but since their working overtime now maybe it will be faster for you to get a case number ;)

- Doesn't matter if it's expired. It proves citizenship. A copy of the bio page is all that is needed.

- NVC case numbers will never work in the USCIS website. They are DOS numbers, Department of State. The NVC is part of the DOS. The USCIS is part of the DHS, Department of Homeland Security.

Because it's taking significantly less time for the NVC to accept and process the I-129F, they may send it to the embassy. At which time you may inform the embassy you no longer want to continue withe the K3 route.

- you cannot get a transcript saying you didn't not file a tax return. All that is required is a letter stating you did not file and why.

- if you are using 1099 you do not qualify to use the I-864EZ. The 1040 should be an exact copy of what was sent to the IRS. It's much easier to just include a tax transcript unless you are trying to include 2013 taxes.

Are you currently working? Do you have a joint sponsor?

Question-if u have W2 and 1099 my W2 shows earned income of 62 thousand and the 1099 only let's say reads 100 bucks I can't use the I864ez anymore? Because I have a 1099? Or is it only if I was basing it solely on the 1099?
