Congratulations to you for getting your Case # etc. Now things will happen quickly -DS261, AOS Bill, IV Bill, etc. I have no doubt we will be with our families in a matter of (no more than) 3 months.

Thanks for posting the link to the DS260. This current version is only 8 pages long.

Maybe Ms Saylin can include that link in her Post 1.

As I was reviewing the DS-260 I had two questions:

1. When we enter the last three addresses or last the employments do we enter them in most recent ones first, oldest last?

2. Do we enter month and year or do they want us to specify the date, too?

I don't really need their refund from the joint filing but want to follow the correct procedure. I am sure most of petitioners pass through the same procedure and I will appreciate if you can share me your experience on this. Thanks a lot for your help.

I am planning to file 2013 taxes as MFS. I understand I have to put NRA (in place of SSN) for my wife (beneficiary). My question is, if I print and and mail the forms does she need to sign the 1040, too?

In which case I will have ask her to print a blank 1040, sign it and then mail it back to me.

There is a tax section on VJ but as mentioned earlier I filed as married filing separate. I live in California which is one of the states that has community property laws which makes things more complicated. Since I haven't lived with my spouse more than 6 months I dont have to count her assets as community property. When you file with a NRA spouse who has no social security number you may have to print the forms to write "NRA" in the SSN section. You will do this on turbotax for sure but apparently there are other programs out there that will let you do this electronically. If you wish to file jointly then there is a seperate process of which I am not familiar with.

Legally you are required to file as married and not single. Whether the IRS finds out you are actually married is another story. I got married in central america to a canadian woman so there really isnt a way for the IRS to know I am married unless I tell them but I still followed the rules.

You can expedite to process if you do as I did. My Accountant is a Acceptance Agent (AA) authorized by the IRS.

They took the W-7 and my wife (beneficiary) documentation and faxed it directly to the IRS.

Given the current delays with processing returns it was the quickest path to still be able to E file.

one more question.

i was planning on sending my wife passport copy from passport office

but in India its pain in butt, we have called the passport office 4 days straight and no one picks up phone, process is very slow there

on the form W7 it says i can send some USCIS documentation , do u know what type of info that would be ? (noa2 notice ???)

Nope, the spouse only needs to sign if it's MFJ.

It might be that the AOS department got backlogged, so it took them longer to officially "receive" the second package. That's the only reason I can come up for that. But, it's not really a big deal either way.

Thanks. Didn't really think of them as having different departments for "AOS" or "IV", but that makes more sense.

File as MFS for now, then amend to MFJ once your spouse has immigrated and has gotten a SSN.

Were you able to submit the DS-261? I did yesterday. However, the AOS fee bill is still locked.

We were assigned one day after you. I still cant log in or fill out DS261 yet. AOS is not invoiced.

I see from all of you guys' timelines, you were able to submit DS261 a day after, so I should be able to today.
