Are you saying that if you DID NOT FILE, a transcript will verify that you did NOT file? YES- interesting point..... probably NOT a bad idea if you have a transcript verifying your statement and there is NO cost- you can request a transcript over the phone without actually filing a 4506-T.

YES - IRS is backing up your statement.

Yes there is no cost to get that. takes some time though.

Since your husband's father claims him as a dependent, I believe his father needs to file I-864A (Contract between Sponsor and Household Member) instead of the normal I-864 as joint-sponsor.

http://www.uscis.gov/i-864a

This will also change the answer to the Household size question in Part 5. Question 7 of your husband's I-864. He will need to include his father, along with you and himself in the household size. This could potentially change your poverty threshold.

Thank you for your advice!

I don't really understand why though, as his father is the head of the household, why would it be a problem if he files the I-864 form instead of the I-864a (combining incomes doesn't make lots of sense as my husband has no revenue and was filed as independent on the father's taxes)...

Argh I am kinda lost as most of the previous threads on VJ say that it should be a I-864 form. wacko.png

Thank you anyway for your answer!

He is a US citizen, lived in the UK, now moved back to the US. I am French, we met in 2010 in the UK and got married in March 2013 in France.

Good morning guys,

I got my case # two days ago, I am able to log into the https://ceac.state.gov/IV/LoginError.aspx?errorMsgCd=E2 to fill out the DS 261, how long should I wait? also, I have not received an email yet, I know I should wait around a week for that, but I see other members that they were able to fill the form ds 261 after a day.

So sorry everyone, but I am still completely lost... cray5ol.gif

Does my husband's father has to file the I-864 or the I-864a form? I read both answers on VJ...

Anyone was in the same situation and could tell me what they've done?

Thanks!

Hi everyone!

We are preparing the AOS package, and now I have a huge doubt on what we have done (maybe I read too much on this thread and freak out to receive a checklist!).

My husband had no revenue for the past 3 years (as he was a student in the UK). His dad, who's also our joint-sponsor (incomes are way over the poverty line so it shouldn't be a problem), put him as dependent when filling his taxes for the past 3 years. So, this is what we will include in the AOS package:

Petitioner:
- Bar-coded cover sheet
- I-864 form filed by my husband
- IRS letter of non-filing verification for 2011, 2012 and 2013.
- IRS tax return transcripts for 2010 (just in case!)

and joint-sponsor:
- I-864 form filed by my husband's father (joint-sponsor)
- IRS tax return transcripts from 2011 to 2013
- 3 months pay stubs
- Copy of US passport's biographical page
- Copy of petitioner's birth certificate showing father's name

We will also add proof of US domicile (bank statements, driver's licence, gym membership) AND all pages of his new passport (as he had to renew it in january).

Does it look okay?

Also, my father-in-law's household is also composed of his wife and the grandmother, filed as dependent for the tax returns. As they are not working, they don't need to fill in the I-864A form, right?

I am sorry for all these questions, I am getting lost...

I would appreciate your advice! Thanks a lot

I suggest an I-864.

The only time I suggest using an I-864A is if they're a spouse of the main joint sponsor. For an example, the petitioner's father is the main joint sponsor (I-864) and his wife, the petitioner's mother, wants to contribute as well, so she would file an I-864A.

Thanks Saylin!

And as our joint-sponsor's wife is also filed as a dependent (not working and no revenue), I guess there is no reason for her to file an I-864A.

Nope no0pb.gif If the joint sponsor has a high enough income for the household size, that's all that's needed.
