Checked email today and got the interview appointment letter- April 28!!!

I read throughout this topic that we shouldn't leave any blanks on I864 to avoid any checklist... So I think you should put N/A...

Instructions to I-864 clearly say to leave items blank if they are not applicable to you.

I know people may think differently here, but it seems that we have to follow instructions. Also, if you file online, it is not even possible to put N/A in some items.

Hi everyone!

We are preparing the AOS package, and now I have a huge doubt on what we have done (maybe I read too much on this thread and freak out to receive a checklist!).

My husband had no revenue for the past 3 years (as he was a student in the UK). His dad, who's also our joint-sponsor (incomes are way over the poverty line so it shouldn't be a problem), put him as dependent when filling his taxes for the past 3 years. So, this is what we will include in the AOS package:

Petitioner:

- Bar-coded cover sheet

- I-864 form filed by my husband

- IRS letter of non-filing verification for 2011, 2012 and 2013.

- IRS tax return transcripts for 2010 (just in case!)

and joint-sponsor:

- I-864 form filed by my husband's father (joint-sponsor)

- IRS tax return transcripts from 2011 to 2013

- 3 months pay stubs

- Copy of US passport's biographical page

- Copy of petitioner's birth certificate showing father's name

We will also add proof of US domicile (bank statements, driver's licence, gym membership) AND all pages of his new passport (as he had to renew it in january).

Does it look okay?

Also, my father-in-law's household is also composed of his wife and the grandmother, filed as dependent for the tax returns. As they are not working, they don't need to fill in the I-864A form, right?

I am sorry for all these questions, I am getting lost...

He is a US citizen, lived in the UK, now moved back to the US. I am French, we met in 2010 in the UK and got married in March 2013 in France.

Hello guys, i am Jaba from Europe Georgia, Tbilisi. My wife is Vivian from TX, USA. Obviously i am beneficial, we are PD 21 October 2013 filers. Based on statistics provided by spreadsheets we will get our approval (NOA2) at the end of the current month or at the beginning of the April.

Why i got here ?

Because of approval is soon and i am not ready for NVC procedures i decided to start researching information and making papers ready to meet NVC procedures and not lose time after. i am sure all of you did on your certain time. BC of you already are on NVC procedures i believed you would know everything much more than people from October filers who are waiting approvals by USCIS like me.

Huge thanks to Saylin who does a lot for all of us and without her VJ would be less effective and clear.

I read almost all link provided at the beginning of the forum and a lot information caused confusion in my brain smile.png So i am here with hope you guys will help me for my NVC procedures, bc of i am from Georgia i think Georgian beneficial can provide more accurate information for me. All respond is appreciated !

What i know well it is:

1. When NVC will receive my case after 1 week i need to call and provide My wife's (petitioners) and mine (beneficiary's) Email dresses to them. Also ask for NVC case # and IIN (invoice identification number).

2. When i have Case # and IIN i can enter in system and make DS-261 (choice of agent in my case agent will be my mother-in-law who has US mail address and i will get fast mails without losing mails and delays as i experienced with NOA1 hard copy).

3. DS-261 is already submitted electronically i must check if bills are made if yes pay both or separately depending how fast they will appear.

4. i got bar code cover sheets so now i need to start work which i don't know certainly (Making AOS and IV packages and express mail).

Guys please confirm if way i see process till 4 is right and help me to figure out about below issues.

Please guys someone give me actual check list of AOS package which you guys sent and works i am worried about not send package with missed papers or not proper bc all my knowledge is based on much forums and less official instructions which i barely collected and still confuses me. (for i-864 purposes i want you to know that my wife lives with me in Georgia since April 2013 and therefore we need joint sponsor who is going to be my father-in-law, so i want guys you to put joint sponsor requirements at checklist too. and also i am not sure which form my father-in-law must fill, i-864 or i-864a, my wife and i are going to live with my brother-in-laws and father-in-law after arriving in USA)

Also please give me IV Package checklist. I want to make ds-230 not electronic one (ds-260)

Don't think guys i am lazy to research forums just i read so much it made me more confused and just i want to know from people who actually did it without any doubt about checklists and so on. Any respond will be highly appreciated ! Thanks all

What i know well it is:

Once AOS and then IV are paid you print out bar coded cover sheets and once they show paid then you send off packages

I don't think you can mail the DS-230, you will have to do the DS-260. thought I am not sure.

List of documents for both AOS and IV are both in posts 1 and 2 of this thread.

Good day vjers..i called the NVC this morning and i was stunned to find that we have case number and IIN.my husband went to our attorney just yesterday. I checked our status at CEAC this morning and i did signed in. But right at this moment, i can't sign it.. ther is an error message like:

Please be advised that the case that you have attempted to access is not eligible for further processing by the National Visa Center at this time. Please contact the National Visa Center if you believe that you have received this message in error.

I-130:
2/28/2013: Attorney mailed the I-130 from a U.S. address.
3/4/2013: Priority date, NOA1.
11/6/2013: Case was transferred to Nebraska Service Center.

1/6/2014: 60 days of transfer are up, put in an e-request, given 30 days' time. Contacted the senator. Senator asked to wait till Feb 6 and if nothing then she will do something.
2/5/2014: Website status changed to RFE.
2/10/2014: Attorney gets RFE. They need G325A and photos of both me and husband, original marriage certificate, copy of marriage record and it's translation.
2/15/2014: Mailed the requisite documents to husband.
2/19/2014: Documents received by husband.
2/24/2014: RFE mailed.
2/26/2014: Case status changed to RFE review.
3/6/2014: After 367 days, NOA2.

After approval kept calling NVC but NVC always had one reply, file was not in their system. Husband too called USCIS National Customer Service Center and was told case was sent to NVC.
4/2/2014: Write to NSCFollowup to know about the status of the petition.
4/10/2014: Put in a ?service request with USCIS starting with OVP to locate case.
4/16/2014: Reply from NSCFollowup that the U.S. law prohibited that office from responding to anyone other than the petitioner and to have the petitioner contact them.
4/18/2014: Sent email to NVC Research to locate the case.
4/22/2014: Petitioner sent email to NSCFollowup
5/14/2014: Receive email from NVC Research that they do not have a record of receiving the petition.
5/16/2014: Congressman's immigration caseworker contacted supervisor at NSC who said the petition is pending and will be dispatched in two weeks.
5/27/2014: Petitioner received response from NSCFollowup that the case was pending an internal extended review. Really?
6/19/2014: USCIS case status change, "On June 19, 2014, we shipped this case..."
7/1/2014: Case received at NVC.

So, this is what we will include in the AOS package:

Since your husband's father claims him as a dependent, I believe his father needs to file I-864A (Contract between Sponsor and Household Member) instead of the normal I-864 as joint-sponsor.

This will also change the answer to the Household size question in Part 5. Question 7 of your husband's I-864. He will need to include his father, along with you and himself in the household size. This could potentially change your poverty threshold.

Please check questions, i read 1,2 and have additional questions.

Questions about AOS:

1. My wife is living with me outside USA and haven't worked ever so she doesn't have any tax record. Must i mention in AOS cover paper ? i don't want they to think we missed it so how is right on this case?

2. My wife and i will immigrate at home where my Father-in-law and Brother-in-law live, at the same time my Father-in-law is going to be joint sponsor. Because we will live with family member who will be also joint sponsor do we need to make him to fill I-864a (yes, just i want confirmation).

3. Must we send original birth certificate of my wife (petitioner and primary sponsor) as evidence of family relationship? Like that joint sponsor and petitioner (primer sponsor) are relatives.

4. Must we use original IRS tax statements for sending NVC ?

Questions about IV Package

1. Will in be better if we will send proof or ongoing relationship (pictures, messages, emails, so on)

2. I need to submit original beneficiary (my) Certificates: Birth, police, military, marriage if all are in my native language which is not English can i translate myself to English ? So i will send original certificates with translation papers with them.
