Dear Saylin, NLR and others,

I have a question, and in search of some advice...

I have sent in my AOS package already, which I thought I was sending after much consideration and review but I might have missed something.

I sent:

I-864EZ

2013 Tax Transcript (Filed married jointly she has a SS# from her time here on student visa)

2012,2011 Tax Transcript

Employment Letter stating current salary

All paystubs from 2014

In 2013, all of the income is mine but as stated in another post it's not distinguishable via the transcript alone. I didn't include any of the W-2s since I was sending the transcripts. However, I am thinking now that the 864EZ requires all of the income be personal W-2 income. Do you think they raise a checklist to prove that it was in fact my income in 2013? Note that, annual salary info in the form and the corresponding employment letter/paystubs show that I meet the requirement for the AOS. Plus my single filed 2012 and 2011 show W-2 incomes that meet the requirement.

I am considering, if I should go ahead and send in the W-2s separately regardless with the same cover sheet and cover letter explaining the additional document to be added to already sent package. I am concerned that this might screw their system up with me sending two packages and cause unnecessary delays. Do you know of any instances when somebody sends in additional documents separately before any checklists are generated? Should I send in my W-2s now and take the chance or just hope they don't generate a checklist. oops8rh.gif

1. DS-260 and DS-261 are online forms.

2. The email you send now is now ENROLL, not OPTIN.

If your not doing the ep can you still do the DS-261 and DS-260 online and mail in the Aos and IV package? I mainly want to do the DS-261 online and everything else in the mail. Is it going be faster doing that online than having it sent to the beneficiary and back to nvc?

Sorry if this is being repetitive but I'm extremely confused.

1. I ve been reading about DS3032 there. But we are not filling DS3032 now, right? So, replace all the DS3032 with DS260 and DS261?

2. And everything else is the same? We will still send in the OPTIN email for EP AFTER the AOS bill invoiced? And wait for a GOZ number after the GUZ number?

Ive been studying the Montreal page...but finally I ve come to the right page for Chinese beneficiary!!!! And after reading it, feeling a bit confused.

That's not my wiki, it's Darnell's. Looking at the history date, it hasn't been updated since August 2013, so no, it's not up to date.

1. DS-3032 = DS-261, DS-230 = DS-260

2. Yes, I believe this is still recommended.

I have a question? We filed 2013 taxes as MFJ with W7 applying for ITIN # for myself. If we can send in the AOS before tax transcript is available(could take 6 weeks) should I send a copy of the W7 application along with tax return and w2's for the AOS?

Yes, send it all. Everything that was sent to the IRS should be sent to NVC.

I saw somewhere that you should bring the original tax returns to the interview? Is this the case and how can we do this if we have already submitted them to NVC?

You can't bring original tax returns anywhere as those were sent to the IRS. The only ones you can possibly bring are copies ;)

Hello Saylin! I just want to ask if I can just present the relationship evidences (like the airfare ticket, pictures, etc.) at the embassy on my interview or it's better to send it to NVC. I already sent my police clearance and other civil documents to my husband coz he will be the one to send the IV package to NVC as soon as IV is being billed. I am just afraid that if I send those relationship evidences to NVC, I have nothing or less to show on my interview. Hope you can give advise regarding this. Thank you! smile.png

It's up to you if you include additional evidence in the IV package or not. This is typically only recommended for MENA countries though.

Ms Saylin . NVC recvd file on Feb 28th 2014 .. can u plz update the sheet ,, thanx... another question - i have been trying to contact NVC to get the case no from NVC they keep telling me call back after 30 business from the date of receipt of the approval. what should i do ... wait !! or ...

plus,... am a USC and not been working for the yr 2013, though have 2011 & 12 1040 and W2.. do we need a co-sponsor ..

And yes, it's taking quite awhile to assign case numbers. If you looked at the spreadsheet, you can see this for yourself.

That's not enough information to tell you if you need a joint sponsor or not. Are you currently working? If so, are you above the poverty line for your household size?

Since you quoted INSIDE a quote, this didn't show above, but you mentioned your service center was CSC, not NBC. I'd like to point to both your profile and timeline that both show NBC as your service center. Please update if California was indeed the correct location.

DS-261 (Choice of Agent) and DS-260 both have to be done online. Mailing them is not even a choice. Now, either the petitioner or the beneficiary can log in and complete them. In our case I (petitioner) will be completing both of them when they are available. We just got our Case # and IIN today. So it will be probably a week before they become available.

The AOS package will need to be sent by mail. Online or email is not an option for India. Same with the IV package. Needs to be mailed.

I am going to put them together after I receive the documents from my wife (in India) for the IV package and mail them from here.

Also, please read posts 1 and 2 in this thread. They have a wealth of info about the NVC process. Request Ms. Saylin to add you to the worksheet she is maintaining.

Kept calling all day. Finally around 4:30 (PST) got thru' to NVC. Gave them my wife's (beneficiary) email ID. They already had mine. Got the Case # and IIN.

She said wait for the email from NVC until I will be able to view the forms/bills.

Too excited, can't write any more. Got to call wife although it is still very early in the morning in India.

Ms. Saylin, please update my entry - Case # Received 3/11/14.

Quick question on AOS package. Do I really need to wait for the Payment Status to be PAID before I send the AOS package? What is the complication if I send the AOS package it while it is still IN PROCESS?

Our petition has still not 'arrived' to the NVC. We are approaching 7 weeks since it was sent from the NSC. I called the USCIS and they confirmed it was sent.

I know we don't have a 'case' until we've reached 8 weeks.

Any thoughts?

Hi again, I have some annoying questions that relate to my earlier inquiry. So our plan is for me (the sponsor) to move to canada for a few months during this NVC/Interview process so that I can be with my wife. We have already submitted the AOS packet and are waiting on the IV Bill to be generated. Since I will be quitting my job in order to move I will need a co-sponsor which I already have since when we started the I130 process oh so long ago I was at university and only working part time (but we didn't use him when we submitted the AOS since I am now employed). I can easily prove domicile when it is time to come back as I have a permanent address here in California, my drivers license matches that address, as does my american bank accounts, retirement accounts, vehicle registration, etc. (I will also obtain an employment letter to help show I am moving back to california when the time comes).

So my question is when do we send in the new I864 for me and the co-sponsors I864 and supporting documents? Do we do that now or do we just show up with it at the embassy? Thanks!

hi! saylin got a checklist from nvc asking us to send i864. how long will the case be completed after nvc received the checklist. only aos is lacking in our case.

Same amount of time as it took to review the package in the first place.

Please add above info to the spreadsheet. Thanks a million Saylin for your wonderful work
