If the first 3 letters of your case number are MEP, then the person who told you that electronic processing was unavailable for Mexico would be incorrect. If a case number starts with MEP, then electronic processing would be required.

Myself and three others that I know of have the same received date as you and we have no case numbers either. Check out Saylin's spreadsheet- everyone from the 24th of January seems to be finished now so we've got a while to go. Plus 20 business days, excluding closures due to weather and holidays and weekends, is on Monday. Right now the NVC says 20-30 business days is the average for a case number. Hopefully our files be touched soon!

For both MFS and MFJ, the petitioner will have to file a paper tax return. Electronic submissions won't be possible the first year.

Filing MFS will probably be the easiest for most people as it doesn't require any extra documents from the foreign spouse, nor does it require their signature. On the tax return, where it asks for the spouse's SSN, you would put 'NRA' for Non-Resident Alien. Continue filling out the rest of the return as normal. That is all you have to do. (And if desired, once the spouse has immigrated to the US and has obtained a SSN, the petitioner can then amend their tax return to MFJ, to possibly get a bigger refund, but this isn't required.)

I wanted to add something I found from calling the IRS Customer Service Center (800-829-1040) on manually filing MFS by mail, per the instructions above. In addition, they also suggested attaching a cover letter to the Form 1040 and supporting documents (W-2's, etc.) explaining that I am married to a Non-Resident and have manually written "NRA" in the space for his SSN. Hope that helps a little.

Are you referring to the DS-260?

And the form is filled by the beneficiary, so put their address. If they've been living in the same place their entire life, then the "from" date is their 16th birthday. The "to" date would be written as 'present'.

they already give 16 birthday year and they want me to put the year from so will it be problem if i put his birth year 1982 because he is there his entire life

Unless you had a lawyer when you filed the I-130, it will not help at the NVC stage. With a lawyer assigned, DS-261 isn't generated and the lawyer is assigned as an agent automatically, potentially saving 3-4 weeks. The key is to have the NVC not generate the DS-261, I don't believe there is a way to avoid that unless you had a lawyer at the i-130 submission.

Getting the case number assigned won't be quicker, but once assigned you'll save a good amount of time. When case# is assigned you can pay both AOS and IV bills. So if you are ready to send those packages out quickly after the bills are paid the only waiting you'll have is to get the case# assigned initially and them reviewing your submitted docs.

Feb 20 NOA2 here from CSC.

Haven't called NVC to see if they have received our case yet. However Lisa y Miguel who also has an NOA2 on the 20th called and posted that her case was received on Mar 4th.

We got NOA2 on Feb 19 from CSC. I just called this week and they told me that they recieved our case on march 03. yes.gif

how did you guys know the date they are currently working on?

Myself, I was just guesstimating from 4 or 5 other kind folks that said they received their case numbers between 3/5 and 3/7. Their files were first received by NVC from 1/24 to 1/29. "Rough statistics", if anything.

So who sends the documents for IV package and AOS package etc.? I had a lawyer do i130 for me and due to G28, there won't be DS 261 generated for me once I get approved. Do you recommend letting my lawyer send the docs on behalf of me? My concern is he is very busy and hence not as proactive as I would like him to be. Montreal allows EP so I am thinking to submit docs myself.

Hi, I have an attorney as well but we have very good relationship and i explained to her that I have been waiting for over a year now for my spouse to come and that I will be sending the IV and AOS packets. It is just faster that way they can assist you with any questions but you know that you will take the most uber care of your work because you want it done asap ;)
