Passport in married name

I did not have my spouse do this but now that we are all done and she is in the USA I regret not taking the time to do so. Her SS card has arrived with her maiden name and the GC will also have the maiden name so now I will have to have her submit the name changes and possibly more fees.

Just reiterating what other s have said, good advice!

Since the GC is in the maiden name and you are a CR-1/IR-1 visa holder, I will assume the passport is still in the maiden name as they typically issue the visa in the name on the passport and the GC comes in that name as well. You could start with the PI passport and get the name changed in that first. For the GC, when you file for AOS all you have to do is indicate the married name on the application and put the maiden name in the "other names used" section. Once the GC is changed you can easily change the SSC and then all other US documents. Just remember that for international travel the ticket must match the name in the passport used. So if the passport is in the maiden name and the GC is now in the married name, the ticket should be in the maiden name and your wife should carry a copy of the Marriage Certificate to help the airline employees make the connection between the two names.

You can go thru all this trouble to get her name changed or she can keep her maiden name. It might be best to wait until she applies for citizenship. Then she can get a US passport in her married name and not have to jump thru all the hoops the PI require just to change a name in the passport.

Good luck,

Dave

It's $450 to get the green card changed into married name. Unless the beneficiary has an IR1 vs a CR1 green card I suggest waiting until the removal of conditions to change the green card. You can bring the marriage certificate to the SSN office to get the SSN changed to married name.

OMG 450$...she is an IR1 also. I guess I will not worry about it, not planning on working and I am thinking we will be living back in the Philippines before she can become a USC. Taxes were filed with her old ITIN which was in her married name, no issues that way.

Married or maiden name, what's the difference, strictly optional. Wife has to maintain her foreign passport, would cost a small fortune to have that changed in her home country, so just stuck with her maiden name. She elected to use her married name on her US passport, with banks and any other institution, only difference is her marriage certificate that, by the way, was her maiden name on it.

When she leaves her home country, has to show her foreign passport along with her US passport, both have her same identical photo on each. The reason why she has to show her US passport is because she no longer has a visa in her foreign passport. But they can see she is the same person with her photos in both of them. So never has been a problem for her.

Ha, I love to tease their POE on this issue, much more fun traveling with my girl friend then with my wife. Other choice is to use her maiden name as her second middle name, done this as well.

Yes, I will not bother getting it changed. In the Philippines the middle name after marriage is the family name she had before, same as when you have a child they get the middle name which was her maiden name, not really a choice naming a child that way and if you do change it to something else it causes headaches with other things as its 'not normal'.

I could have gotten her a new passport with married name for about $30, cheap enough but the waiting in line all day, not for me.

Yes, your time is worth something in the equation too. At least it sounds like you have only one line. In Kazakhstan, you must go here for a form, fill it out, wait in another line, get another form, fill it out, go across town to submit that form. Wait a few days. Go back. get completed form. Stand in yet another line. Hope you have everything and submit it and wait again a few days. Go back and pick up passport. Crazy. This is the main reason my wife's passport is in her maiden name. As NickD says, "It is just a name."

Good luck,

Dave

It will not hurt getting your visa but it will hurt the wallet later on. I talked to USCIS yesterday about changing the name to the married name on the GC but a no go. The cost as posted earlier is 450$. Also signing up for healthcare today and I am hoping it will not affect that either. Hindsight is...20-10?

Having her green card in her maiden name will not effect anything. She can use her your marriage certificate in the USA to sign up for everything under her married name including her SSN and state ID. Once you have the state ID and SSN in the married name, the only time you'll use the green card is to leave and enter the country.

Passport renewal time you will pay if you want her new passport in the married name, which I think would be required. Also signing up for family healthcare and other unforeseen issues, ran into another one today. Change it if you want to save time and money cause in the end it will bite you.

State ID...did not think about this but not a bad idea to get a non driver license ID just for the fun of it.
