Today we went to apply for Neil's social security card and the lady told us that he's "considered allowed to work". We thought this was quite strange since he isn't allowed to work. I told her we thought he wasn't allowed to work and she said according to "their records" he is. Has anyone else experienced this? I guess we will have to wait until his card arrives to see if it has the restrictions on it. We just thought it was quite strange.

K-1s are technically considered 'allowed to work' for the time until their I-94 expires. The problem is employers require proof of this, and the K-1 visa is not listed as proof for their requirements so it is unlikely that an employer will hire a K-1 since they don't have the necessary proof. Some POEs will stamp "Work Authorized" on the I-94 and that is considered acceptable proof, but most do not and you usually have to request it at the ones who do. The good news for your husband is that since he is considered allowed to work, he is eligible to receive a Social Security Number. If he were not eligible, he would receive a denial letter advising him of the fact that he is not eligible for a SSN until his status is changed:-).

btw - my SSN card arrived without the stamp stating I needed permission to work. It seems most people do have that stamp and have to apply to have an unrestricted card issued after they apply to adjust status.

What did you guys bring to the SS office to apply for the new SS card? Here is what I am going to bring.

1. Passport

2. I-94

3. Birth certificate

4. SS-5

Is it right or you guys bring more stuff? Thanks.

We had to wait for and then take the green card before St. Louis would issue a social security number.
