Hi Everyone,

Quick question - I just sent my aos package off to Chicago, but I only included the fees for the I-485 ($325) and I-765 (180). I forgot to include the fee for the I-130. Is this going to get my case declined, or will they just ask for the extra when they start proccessing it?

Hi Everyone,

I've read about certain applications for benefits (e.g. Advanced parole) being returned for paying an insufficient fee. Perhaps someone else has personal experience with this.

There is also a $70.00 Biometrics Fee for the I-485. If you did not include that, they will return your whole package to you and request the correct fees be attached to your package.

If you are applying as a K-1 you do not need to include an I-130 nor the fee. You do need to include the biometrics fee, however. If your package gets returned re-submit it with the proper biometrics fee. The I-130 is not required so you can remove that application and not worry about the fee. The one exception would be IF you married after the 90 days date recorded on the I-94 then you are no longer able to file AOS based on a K-1, and then would need to include the I-130 as the basis for the AOS.

Thanks for your replies, some mixed opinions on this one! I managed to get my appartment manager to open the mail box so I got the package back, and will now take out the I-130. One more thing though, can you pay all the different fees with one cheque or do they have to be split?

I assume that when the green card comes, i'll be able to travel?!

Yes, you may travel internationally after you receive your greencard. However, if you plan on any international travel prior to receiving the greencard, you will need to file the I-131 form for AP.

Some people have their AOS held up for quite a long time due to background checks, so consider this before trashing the AP forms.

We made ours to Department of Homeland Security. I think USCIS works too. There should be instructions on the forms. Honestly though, you could probably make the checks out to Bob, and they'll still cash them.

They will accept all the fees on one cheque.
