I'm pretty sure I'm posting this in the wrong section n this question has probably been asked but I need a little clarification.

My then fiancé came over on a k1 and we were married. Now. Does he file for his social security card now or do we have to wait until he does the AOS?

In general, only noncitizens who have permission to work from the Department of Homeland Security (DHS) can apply for a Social Security number. If you do not have permission to work but need a Social Security number for other purposes, see “If you do not have permission to work” for further information.

A K-1 is entitled to a SSN.

8/17/10: INTERVIEW DAY (day 123) APPROVED!!

I called social security and they told me he has to file after he gets the work permit through AOS.

So I guess we'll have to wait until that's completed.

And you may get somebody in a local office who knows nothing about K1s. Thay are rare in the grand scheme of daily life at a SocialSecurity office. Take the printout...at least through the page containing K1. Politely ask for a supervisor if the worker seems unsure. Take the passport and printout of the I-94 as ID and proof of legal entry. good luck. There are many stories about experiences at local offices. Know you are eligible. You can't work without a greencard to go with it, but you CAN get the number now.

We did not get the SSN before we got married and sent in the AOS. Our work authorization is supposed to arrive tomorrow. This will allow us to go to the SS office, right? What else do I need to bring? The I-94 is expired since we got married in October but we will have the employment authorization to bring. That is ok, right? Thank you!

Yes, you can use the EAD to get your SSN. You need to fill out the ss-5 form and bring your passport too. > http://www.ssa.gov/online/ss-5.pdf
