My partner and I are soon going to file our k1 petiton for a fiance visa but im a little confused as to what happens once we get married.

I know you have to file an adjustment of status but im confused as to how long that takes and what situation that leaves me with?

Am i able to leave the country while the case is open or am i not legally allowed to leave while it is being processed?

I know I havent even been approved for the visa yet but I just thought id get a little help from people who have been through it.

Once you're married on the k1 you have to file for adjustment of status in order to be in a new legal status. The adjustment is basically your application for the greencard.

To get The greencard can take from 6-12 months or even longer. During that time you're not allowed to work or leave the country, UNLESS: Along with the greencard you CAN file for a temporary work permit (called EAD) and a re-entry permit do you can travel (called AP) these two permits are free of charge only if you file for them along with adjustment of status and usually you get these documents within 60-90 days.

So once you're married: file AOS along with EAD and AP. You will be allowed to work and travel as soon as EAD and AP are approved (usually 2-3 months) Cost for all of this: 1070$

Good luck

Trust me, the adjustment compared to the k1 will be a piece of cake. Don't be overwhelmed. Once the k1 is in process you got the worst part covered. The AOS is simply filling out forms with information that you already gathered for the k1 at some point. And you can always come here to ask if you have questions. It'll all be fine

I might add: copy every single form and paper you use for your k1.. That's what will make AOS easy peasy

So you're good. Put together your petition, check everything twice, then check twice again, then copy everything and you should have a speedy approval. Right now they seem not to take that long
