So me and my husband we filed taxes married jointly, but had an agency actually file it for us. I was against it, but my husband is with the company for years. Now ,me as paranoid as I can be, would like to check if it is correct.

Only thing I am concerned about is, if they had to claim my legal status? I wasn't there with my husband, because I was in school, and he likes to give every responsibility out of his hand. So I can't be 100% sure he checked what they did. If they claimed me as US citizen I know that could cause huge problems for me.

So is there a field on the 1040 that indicates your legal status? My ssn is on there but that's about it from what I can see.

Nothing about your legal status is required. No declaration of citizenship, lpr status, nada.

That is not necessarily true in her case. Since at the end of 2013 she was still a non-resident alien, the only way they can legally file a joint return is to make the election to treat her as a resident alien. By making this election your are notifying the IRS of your legal status. They may have not made this election but I doubt if the IRS would have any reason to question whether they are entitled to file a joint return.

My wife and I filed our taxes in Jan. We went to the IRS Taxpayer assistance section and the lady said (if she has a ssn# ) she can file. So we filed and 3 days later we got our refund. When I used the online tax software it asks if you are a qualified noncitizen and had a formula to figure out if you qualified as a dependent or a deduction.

I will have to wait until the 4 kids get there ssn's later this year then I just need to admend our tax for this year.
