I'm confused. I always get confused at tax time. One year H&R Block wouldn't file for us because hubby didn't have his gc yet.

Okie dokie that form doesn't look too terribly hateful. What sucks is that I need to send in like original documents (his passport to be specific). I sooo don't particularly like the idea of doing that but I suppose we have no choice. I'm wondering what they would think of me putting his mailing address as mine (I don't feel comfortable at all with them trying to mail that thing back to Mexico-it would never make it!)

I can't believe this! So basically I have no choice but to get him a ITIN number? What if we don't want one, LOL??

Lol...then dont file as married. It is just a number assigned to him for records. Not al all difficult to do. I did it for 2 years. My husband is now here and has his ss so we nolonger need the TIN.

Why dont you want to file for a TIN?

Now some say they file as HOH, I have not checked that out. But I would think that hubby would need a TIN as well for that classification.

I do lots of tax returns, been doing it for many years. How some get away with the way others process their returns I'll never know, unless they come up for audit, but I suppose we wont hear those stories.

No no you dont need his passport. Can he go to the US consulate and have his passport notorized there?

I'm glad that you started this thread I have a few (filing taxes) for my alien spouse questions too. He arrived on a K-3 in Oct. 06, but still has no soc# (filing AOS 01/xx/2007).... so I guess I should wait until he gets it to file.

BTW what is an ITIN number?

Who ever is the US citizen is the one filing the forms. You would use an American address.

Why is he waitng for a ss? Go and apply for one. What is the hold up? My husband got his right away. He arrived Aug 10, 06 and started work in Sept.

ITIN=individual taxpayer identification number

Your husband MAY be able to get one of these, it depends.

What I did last year was file as Married filing jointly (as Atif was here right before I sent it in)...I wasn't allowed to claim as a dependent because he didn't have a SS# or ITIN....Also wasn't allowed to take the EIC for my son b/c Atif didn't have a SS#--even with ITIN, not allowed to take EIC until they have a valid SS#. So now filing a 1040X [amended return] and am now allowed to claim Atif as adependent and allowed to take the EIC.

I learned about the 1040X b/c I worked part-time in an IRS processing center during 2006.

Oh, I didn't realize one of those numbers was necessary to do Married Filing Jointly. I'm just curious as to the alternative-would that be filing Single?

No no no no. You cannot file Single if you're married. The alternative is to do Married Filing Separately;

however he wouldn't have to file anything since he had no income.

Umm, I think for her to do so she will need to supply his SSN, or Taxpayer ID, niether of which she has (for obvious reasons).......

Ok I am the USC and my husband is Mexican. According to the instructions on the W-7 (application for ITIN) HE as the alien is the one who applies for the ITIN so it needs his signature and his identification (they are asking for an original passport). Problem is, I don't want to send them his original passport only for them to try and send it back to his Mexican address (it will never arrive). So the only option I can think is to list his mailing address as my own. However, I'm wondering if USCIS ever gets wind of this that they'll be like, what do you mean his mailing address is your address? Was he here or what? I'm not really interested in causing those kinds of complications. Aside from all that, it says if you apply for an ITIN you must file a tax return. Well, there's no reason for him to file a tax return since he's been out of the country and with NO US income. So basically, I don't get it, and I don't like it....

To my understanding K-3's cannot get a ssn# until they get their EAD or Greencard.

It is almoist always more advantageous to file as married filing jointly than married filing seperately...

Just about the only time that married filing jointly is not more advantageous is if the alien makes more than the $80,000 foreign income exclusion end even then it's usually more advantageous since you can get a foreign tax credit on any taxes paid to the foreign country on the foreign income...

If you do file as married filing jointly, you can choose to treat your non-alien spouse as a resident alien for tax purposes by filing a statement of this election with your 1040. You would then also need to file an W-7 with the tax return to get an ITIN for the alien and file the return to the International Tax Office in Philadelphia.

Don't cheat yourself.. if it's more advantageous to file as married filing jointly.. do so...
