To the OP... This has gotten stupid.... Anyway, back to YOUR situation... As others have said, unless you used someone else's SSN to work, you should follow the guide to file formAdjustment of Status... Do not leave e USA... Once the I 130 and 485 is filed along with all the other supporting documents, you will be in status while it is processing... Follow the guides and if you need specific info, just ask. If you feel more secure getting a lawyer, by all means go ahead, but from the initial info you provided, it seems like a straightforward AOS case... Good luck

Sure he is.... He probably has 0% change of getting asylum case approved, and probably close to 100% of getting AOS approved. Why would he use your advice ?

My boyfriend came to the us without a visa and our lawyer did every thing for us. But he couldn't leave the country until he did. We got married march of last year. Didn't know it would take as long as it would. We just thought he could get a green card and that's it. Maybe you could do the same thing.

We met, we dated, we got married, filed the papers to stay here, and now we're waiting for a green card!

As long as he has his I-94 that proves legal entry, overstayed won't be an issue. I hope his wife is a US Citizen and can support him financially when it come to status adjustment.

I overstayed my B2 Visa for 12 years, got my Green Card 3 years ago and now I am in the process of getting my Citizenship.

Do not lose hope.

I was in the same boat as you are. I overstayed 5 years. I married and had my AOS last year. The IO didnt even ask about my previous status. Just be honest and file the necessary forms. You have a kid which is more than any documentary proofs (although you still need to bring or provide them). I wish you the best and your family as well.
