Hello
first, forgive me if this topic has already been discussed,

i came to US on a B2 visa, overstayed and got married! and here is my story (a true one):

i landed in L.A and my plan was to stay there for 2 months and 2 in Nashville, after my arrival in Nashville i was looking for a hotel and asked a lady for directions, her name is Amanda, somehow she was going pass there so we walked and talked for like 45 minutes and met each other, i told her that iam from iraq and she asked about my religion and i told her that iam a muslim so we started to talk about religion, until that time i didn't know anything about christianity but she told so many good things about it, for e.g Jesus techs us to love our enemies, and she got me a copy of Holy Bible, i read it, it was really interesting, peaceful, so i converted to christianity, and when i told my family; they threatened to kill me for this and i decided to not to go home (one and a half week before my visa expiration) so i overstayed, i was in with amanda in her parents house, we really liked each other and were always together, after 4 months of my visa expiration i asked amanda to marry me, we were wife and husband after one month, and i started working in a local market, and now it has been 3 years since my visa expiration, we have a 2 months old boy and we're still in her parents house, so i was going to apply an application for adjustment of status but i read many things on the net that have me very confused, for e.g i will be deported to iraq and stay there for the next 10 years because of my overstay and working without employment authorization (iam a dead man if go back there),

tell me what should i do? please explain it step by step, and do you think i will be deported? or can i stay in US while my AOS pending? iam still working btw.

wow, if I were you, I would talk to a lawyer...

Please stop scaring people with your unknown facts.

This is a very simple AOS cases, please follow the guides above that related to adjusting your status within the US. Your overstay will be forgiven if your marriage is to a USC. Your work without authorization will be forgiven as long as you didn't use someone else social security number that could lead to claims that you are a USC.

There is no need to leave he US before this process is completed, it would be in your best interest to not leave the US before the AOS is completed.

Your case is a typical AOS within the US case.

You do not need a lawyer, just follow the directions.

I just applied for my OAS and i overstayed my visa by 13 years.. You dont need to go back..

Why don't you just claim asylum instead? If you go back you ARE a dead man... as you said. May Allah help you through this tough time.

Sure he is.... He probably has 0% change of getting asylum case approved, and probably close to 100% of getting AOS approved. Why would he use your advice ?

There are a lot of just plain wrong information in this thread. I am not sure why.

OP: Overstay is irrelevant/forgiven for spouses of USCs who entered on a valid visa and adjust in country. That's you.

Illegal work is also forgiven, as long as it is plain old vanilla illegal work, not something involving pretending to be a USC or stealing a SSN or other forms of fraud. You also need to have been paying taxes on your income.

If that is met, it should be a simple AOS case. Follow the guide linked above.

This whole story of your conversion, it doesn't matter, really. That's your personal business. Good luck to you.

So I guess you too missed the part about adjusting status is not guaranteed? AOS is discretionary, not a right by USCIS. Madness that you try to justify breaking the law it with "It's ok! You can adjust status and you're good!"

No, I didn't. You're quite missing the part that overstay or even pre-conceived intent to immigrate cannot be used to deny AOS. It is discretionary, but there are clear rules that define when it can be approved and when it can be denied - and you clearly have little idea what those are... Please read, then come back...

There is good and bad in every case, even those with no red flags. So should I tell you that with your petition bearing evidence of being file thru the Morocco embassy you have less than a 75% change of approval from the initial petition. Or should I just say based on the facts you have presented there looks to be a fair chance that your petition will be approved.

I can search and bring to your attention AOS petitions that have many more red flags than the OP and they have been approved. Do some more reading, or if you wish to represent the OP, offer him some assistance.

The AOS might be the best and indeed only route for the OP to sensibly take.

But for one little point.

When you got your job at a 'local market' did you at any time claim to be a US citizen, or use another persons details?

That might be a fly in the ointment.

August 2000: We start e-mailing. I'm in Bosnia, she's in Florida

October 29th 2000: She sends me e-mail asking if I would marry her

October 29th 2000(5 seconds later): I say yes

November 2000: She sends me tickets to Orlando for when I get back

December 6th 2000: Return from Bos

December 11th 2000: Fly to Orlando, she meets me at airport

December 22nd 2000: I fly back to UK

January 3rd 2001: She flies to UK (Good times)

Mid February 2001: Pregnancy test Positive

Mid February 2001: She flies back to US

March 2001: Miscarriage, I fly to US on first flight I can get

May 2001: I leave US before my 90 days are up

June 2001: I fly back to US, stopped at airport for questioning as I had only just left

September 2001: Pregnancy test Positive again

September 2001: She falls sick, I make decision to stay to look after her as I am afraid I may have problems getting back in.

April 16th 2002: Our son is born, we start getting stuff together for his passport

March 6th 2003: We leave US for UK as family

Early April 2003: Family troubles make her return to US, I ask Embassy in London about possibilities of returning to US

April 16th 2003: London Embassy informs me that I will be banned from the Visa Waiver Program for 10 years, my little boys first birthday

June 13th 2006: I-129f sent

August 11th 2006: NOA1 Recieved

After our relationship breaks down she admits to me that she had never bothered to start the application process
