Hi dear VJ member i would love to ask something about a case of my friend the problem is that he went already to Suiss and he lived there more than 1 year illegal so after that he has been sent back to Morocco after they cough him there, so do this situation will impact on his case when he is going to get his visa?i meant CR1.

are they going to ask him about Background check of living in suiss? and the suiss police deparatment cant issue nothing to him because he was not registered on the system?

hope anyone have been in this situation to explain what he should do and whats the solution,

the Swiss police did not register him/her or even got his/her finger prints? but i think if your friend wants to apply for CR1 he/she needs to get a professional lawyer and get his advice as for this situation because if he/she filled the paper works that he/she has never attempt traveling illegally to another country and they found out about this it will cause alot of problems for his/her immigration situation so my advice for your friend to consult with a lawyer and explain the situation to him and even tell him everything that happened to him/her while he/she was illegally living in the Swiss.

Wrong. USCIS won't care about his overstay in Switzerland. It won't have any bearing on his case

Correct me if I'm wrong, but I believe you do have to identify every place you've lived for over six months since the age of 16 and provide police clearance for those places. So while living or overstaying in a different foreign country may not impact the visa application per se, the fact that he lived there for over six months may impact what documents he has to provide.

Police Clearance doesn't necessarily mean that fingerprints were ever taken or that he was registered, in fact, requesting the documentation and showing that they don't have his presence noted or no criminal activity is what they're looking for.
