Hello I have a question regarding LGTB marriage…

I am an America citizen, I have been in Chile for a year living with my G.F, soon I will be moving back to the U.S and my G.F will come with me to visit under the new Visa waiver program (She can stay for 90days). If while she is with me in the U.S, I decide to propose and get married is that consider fraud because she will go with the intention of getting married? I just read in a blog that my intentions could be consider fraud , and I don’t know what else can I do. Here in Chile its not legal to get married so I can not get married here and requesting a Fiancée visa could take a while… If she goes there and I request a change of status, is that wrong? Please can someone clear this for me?

You can get married, but she cannot come to the US on a tourist visa with the intention to immigrate.

So, planning to do this to adjust in the US is fraud.

Fiance visas are going pretty quick right now, like a few months. I'd look in to that.

as harpa said coming to the US on the VWP with intent to marry and adjust status is without a doubt fraud, no bueno. You have 2 options, an 129f for k-1 or get married now in Chile and petition an i130 for cr1 visa. Either way she will have her interview in Chile. the k1 is much faster at the moment. Study the guides at the top of the page. Good luck

They can't, because bigotry.

OP: You're pretty much stuck with the K1 if you want her to come live with you in the US. You could get married in, say, Argentina, and file for cr1, but they take about a year. K1's are going much faster now. I sympathize. Wish I had stayed and adjusted status.
