My spouse is my financial support in the Immigration filing but she started working from june 2013.

She has filed for tax returns and stubs.

She is way above the 125% limit of poverty line.

I would like to know if she can write a letter to NVC while sending the AOS packet stating the same or has she have to add a co-sponsor along with their past three years of income proof and tax returns.

Hi

I am the USC spouse and I moved from India back to USA (after living and working in India for almost 5 years). I started my job in July 2013 and I don't think it will be any issue.

My case just reached NVC and I am submitting 2013 tax forms (My 1040 plus tax schedules plus my W2) as well as my current payslips showing I am still employed with the same company and earn well above the limit.

My past 3 years (2012, 2011, 2010) since I was earning in Rs obviously was not much but for India you only have to submit the most recent year so should be fine!

I don't think you will need a cosponsor or a letter at all assuming she has completed her 2013 tax returns she can just send that!
