I wish to seek help in my matter. Long story short. I entered the US OCT 12 on a B2 VISA to travel. I'm a police officer in The UK. I met my wife online prior to coming over. We agreed to meet and got along great. Before we met i was offered employment with an alaskan police dept. They were confident of a successful sponsorship. She refused to do long distance relationship. She invited me down to her home where I stayed. We became an item. Then we got the news in feb 2013 her cancer returned after 4 years. I thought I did the right thing and turned down the job. In march my visa was expiring so I left the country to visit friends in Australia. Before leaving i proposed and she said yes. I came back after only two weeks due to her chemo making her real sick.I was allowed another 6months. I was her primary carer. And the kids. In July 13 we agreed to marry as she didnt want me to leave. I offered to go back to UK and we could visit each other. Now she has filed divorced she is saying I manipulated her and took advantage of her to marry for my green card. I haven't sign the papers yet.

I checked my status online and my interview was canceled for unforseen circumstances. I called USCIS. They said they probably doing an audit so it comes to a halt. She then tells me about the divorce and states she withdrew her petition. I called USCIS again and they said that I'm being rescheduled for a new date for interview. I asked if the i130 has been withdrawn and they said no why would it.

I have proof the marriage is in good faith and she even changed her last name to mine. Also on Facebook. She also commented on Facebook sbout what a wonderful husband I have been after we got the news of being cancer free in December.

I am now you going for Testing for another police force and they said if successful we would apply to sponsor me.

Where do I stand in these situations . do i go to interview with all evidence I have to show married in good faith . or do I am withdraw if I get employment offer. This is next week. Still waiting on new UCI's interview date.

Please advise , sorry for long story

If you are not married you can no longer get a GC. If the wife won't come to your interview, you are toast on that front.

However, the whole time the AOS was pending you were in a period of authorized stay. Which means that if you can secure sponsorship for a visa to be a policeman, then there are no impediments there because of your failed AOS. Once your AOS is denied you will be given some time to leave the country or begin accruing overstay days. The timing of your visa sponsorship will determine what you will do at that point, either get the new visa and stay, or leave and come back when the visa is issued. Good luck.

Wouldn't you need to be a LPR to become a government employee? I don't think there is a visa that covers that.

Good question, but he said that he had an offer for sponsorship before he met his wife. Maybe in certain areas where the population is shrinking (like Alaska) they have different laws to get qualified people to come and work.

Wouldn't you need to be a LPR to become a government employee? I don't think there is a visa that covers that.

US citizenship is required for most federal agencies, but you can work for the state/city without being a permanent resident. I was employed for the state for the duration of my post-grad F1 OPT work authorization, and they initiated sponsorship for my greencard (it was subsequently abandoned after my plans changed)

Day 79 - 1-31-14: EAD/AP card arrived


Day 114 - 3/7/14: Interview notification text (Interview April 9)


Day 146 - 4/9/14: Interview - Approved in San Antonio, TX

Here my update on the situation.

After careful consideration and financial woes, I did not fight to try and stay in the US. I withdrew my application and left the country back in April. I am now awaiting to sign the divorce papers. Its hard but thats life. well I thought I had a new life in the US but has now gone. I am now back in the UK back in my old job pondering on life and what to do. feel a little lost right now. but got to dust myself down and get on with mylife. you never know whats around the corner.

I am very sorry to hear your story ronun852, and I would not say this if not met people who have gone through cancer, but I would say don't be upset at her, and bitter at her. You don't know maybe, but cancer can and will cause many many pains, and it does change a person entirely. Unfortunately, it is a battle where you'd have to accept that there's no single thing you can do, and it is not easy to comprehend. Her actions were not from evil, it's from the disease. And as for you, don't feel to sad and down. UK is a very nice and developed country, you have many options there, and who knows, maybe your future wife is there waiting for you to notice her. :) And you might going to look back a couple years down the road and will realize that you are lucky you made it back home. Your home will always welcome you and accept you. The other countries (not just USA, all others!) will never really welcome you but more "accept you" and give a "all right, we'll tolerate you, foreign, although we have plenty like you" attitude. Those countries will never be yours truly, and those will never consider you to be theirs either. So try to look at the bright side of things. I know, easier said than done. Wish you the best!
