Hi everyone,

I'm new to the forum and am trying to file an I-129F for my fiance who is from South Korea. There are two questions I want to ask about filling out the I-129F and if you could help me I would really appreciate it.

On the I-129F, there are questions under Part 2 that is under "Other Names Used" (10a-10c). My fiance has a Korean legal name, but she has a nickname that she gave herself (I guess an English name just because it would be hard for people to call her by her Korean name). However, her legal name is her Korean name and she uses that name (which is on all her cards, bank accounts, passport, etc.) for all her legal documents and transactions. Do I still have to list the nickname that she gave herself and put it down or should I just leave that blank?

The second question regards her child. You see, my fiance is divorced and has had one child before. However, after the divorce she no longer has custody of the child. Now that we are applying for the K-1 visa to bring her to the US so that we can get married, do I list her child in the I-129F as well, although she no longer has custody of the child (and therefore the child is not listed under her anymore in her legal documents from Korea)? The information they are asking for is under "Child 1 of Alien Fiance" (16a-19h) of the I-129F. She is not interested in bringing the child to the US and so we would not be applying for an additional visa for the child. We are just looking to get the K-1 visa for her to come here so we can get married.

If you guys have any clarifications on these issues please let me know. Thanks a lot!

Do not list nicknames, just legal names.

Yes, list the child. Since the child will not be coming with her, then she would simply just not apply for a K-2 along with her K-1 when it comes time to apply for the actual visa at the consulate.
