You are looking at AVERAGES of those service centers and not the MEDIAN time. Don't anticipate that the 5mo will include holidays, snow days, govt shutdowns, etc. I can't believe it takes them 5 months to run a background check...that's all USCIS does to our petitions. You would think an agency that depends on aggregate data would have internal access instead of sending batch requests to the FBI. :bonk:

Any idea when this background check starts? Does it start as soon as they receive the case? The response to my service request mentioned that my case is on hold til the background check is complete. It's been 7 months since they received my case...

Yes, call them and tell them you would like to submit an e-request. I called them four times two days ago and today I received my approval... you just got to insist you are outside their normal processing time. Good luck

I am the beneficiary and we have been waiting 206 days for our approval, RFE, or any indication that somebody is looking at our petition in Nebraska.

I called the USCIS a few days ago from Mexico. The person who answered the phone told me she could not give me much information as I was not the USC. But then she asked if I had any kind of visa and if I had been in the country lately.

I told her that I have visited twice in the past 4 months due to work. Then she went on saying that as long as I entered the country legally I could file for AOS. I could not believe the USCIS was advising for me to do that knowing the visa I have is B1-B2.

My husband has lawyers on this. They adviced against AOS using B2 and they even adviced against me renewing the B1-B2 visa in the first place. They said it was very likely that I could be stopped and returned to my country, but that has not happened in the few visits I have made.

When I made this comment in another forum, a lawyer was so verbal against it... said she could not believe a USCIS employee was advising to commit fraud. (I know this is not necessarily the case and I would not want to start a discussion on whether AOS through B2 is indeed fraud or not).

After explaining about the forms and the urls that I had to read, she said I should sit down with my husband and "explore our options".

So... what do you guys think... what are your thoughts? We would honestly rather wait and stay in the longer yet safer path.

Best,

UnaMexicana
