Hello Nebraskans!

Can you please help us find if we can do anything for our petition?

I (the beneficiary) was born and lived my life in Saudi, but still considered an expatriate for being born of non-Saudi parents (expatriates). Holding Yemeni passport, and working in the oil industry, the risk is higher than ever. If I left my job, I would need to find another in short time otherwise I'll have to leave the country. But, to where? Yemen is war torn, and I never lived in it. Not to paint wrong picture, my job is good and my wife and I kind of agreed to keep working overseas for some time to help financially secure our little new family. What is scary is what may happen down the road which worries us.

We called USCIS on the 30-day mark to check on the status. We were told that a decision was made and it's pending processing. No info about the decision. We're approaching 100 days by now. My wife contacted them yesterday and we got that it is still pending processing.

What can be done to accelerate the process?

Will the fact that we are planning to keep working overseas for sometime affect the process? (indeed frequent flying and stay, but delayed move to US)

My father-in-law is writing to the senator, and my sister-in-law living in other state planning to do so as well. Any advice on must-have information in such communication?

My wife is flying to visit, anything can be done at the US embassy to help here?

What can be done to accelerate the process?

Unfortunately, not much. There are a very limited list of reasons that an application will be expedited - (i) US petitioner is about to be deployed (i.e., works in the military) and (ii) if there is imminent harm to the applicant (i.e., yourself). Maybe since you're Yemeni, #2 might apply? However, you mention that you're living in Saudi Arabia, so it may be hard to claim hardship. Your wife should consult a lawyer and see if there are any possible ways you can expedite, however, be warned that it is difficult!!

I'm not quite sure what you mean by this. Do you and your wife intend to stay in Saudia Arabia after you've received the CR1 visa? Just be aware that the visa is ONLY valid for a period ~6 months AFTER the medical examination. The medical examination usually happens before the interview at the US embassy/consulate. As far as I know how long you intend to stay after receiving the CR1 visa should not impact whether you get it or not. In any case, there's really no way for you to provide that information on the I-130 application, so it shouldn't impact the visa processing after all.

Have them call their Senator as well as Representative. Calling is 100X better then writing. You will be typically be transferred to the office's immigration division and then be asked to fill out a privacy waiver. At that point the Senator/Representative's office can contact USCIS on your behalf.

The US embassy will not be involved with your application at this stage and will not be useful at all.

You've only submitted your I-130 application in September 2016!! 100 days is nothing!! The Nebraska service center is currently taking ~5-6 months to process applications. Escalating the situation to your senator's office before 5 months will be largely fruitless.

I 100% agree with you. This is so f****** ridiculous. I also saw on the app that they've been working on end of June cases since the beginning of this month. I haven't seen anyone got approved from July yet. Staying away from our loved one makes life so hard :cry:

163 days for me. July 11th PD. I called USCIS twice yesterday in the morning and 30 minutes before the agents stop answering the phone. Both repeated the same thing. The agency is processing applications received May 2nd and before. There is a backlog at Nebraska. I am within normal processing time call back next month.

Hello everyone. I'm really tired from waiting. NOA1- 12/09/2015. I've been waiting for i130 approval for over one year. I did two service requests already. Last service request gave some hope that we will hear with 60 days but 60 days have past still no approva. We wrote to senator but didn't get any reply. Now on 19th December got the update that our case has been transferred. It has been sent to Vermont now. I'm so tired of waiting guys. Please give me some some words of hope. Everybody's routed to Texas and I've been sent to Vermont. God knows what Nebraska center is upto. My husband lives in Fremont, California. California doesn't even come under jurisdiction in Vermont center. ???

Stay strong. This is indeed frustrating. I would suggest contacting your husband's local government again by telephone, not email.

I know this is difficult. We are all in this together. The sacrifice of separation from our loved ones will one day be rewarded.

Nebraska is so backed up, its ridiculous! Anyone know why all of a sudden there is seemingly no progress? I assume they are still working like they always have, but did someone all of a sudden stumble upon a ton of petitions they had missed from past months? No idea why there would suddenly be this huge slowdown.

The holidays do slow things down. Hopefully things will improve now.

Let us see, they dropped a load of petitions on Texas who seem to have been processed in the "5 months" yet appear to have done little based on those on visajourney who actually log-in and complete their timelines.

 

Where could this be going wrong?:

  • An interesting aside is the AOS ( Adjustment Of Status) level which is very high from those who entered the USA on one visa and then "decided" to be an immigrant.... which is supposed to be a big NO NO ...lol
  • Many many people filed believing Hillary would win and have yet to withdraw their application ...... others fear Trump and bet "lose:lose" so get the papers in as a safety measure to prevent other problems.
  • Staffing levels are short, commitments to IT upgrade and training high, on the job disruption reduces productivity and case reviews.
  • Funding is non-existant ( see point above)
  • It is Nebraska, cannot remember anything exciting, fast, ground-breaking to ever come out of the State? So why would you live and work there if you did not have to "clock-in" to USCIS and other "Govt jobs?"

Then the person answering the phone is telling us the status as posted on USCIS website stating June 2nd is a lie ...... we are truly in trouble if the left and the right who work at USCIS cannot tell a straight story!
