Hi all,

My husband is currently living in India. Our I-130 petition was received by the USCIS on May 9th and we are still waiting on NVC 2.

We are planning to celebrate our anniversary in Feb together. So my husband would have to apply for a tourist visa to visit me here in States while we are still waiting for our case approval. Do you think it's possible for him to obtain a tourist visa while our I-130 is still in process?

No I don't think he'll be able to. But I wouldn't even try to if I was him. Because he may have his regular visa by then. Oct will be yall 5 mos then on to NVC. So If everything goes well and smooth. He maybe here by yall anniversary.

Can someone help me with I-864 query? I-864 asks for last 3 years of tax returns, but I only have last 2 years of tax return and my current income is more than sufficient to sponsor my wife. The reason for not having 3rd year's tax return is that I didn't earn any income and my parents claimed me as a dependent. So is this going to be an issue? do I need to submit any additional documents? And for the questions where it asked if I filed tax return for 3 years, should I put yes or no?

Everything you sent the first time when you filed is the same thing you send to NVC. Do not change anything up. If you sent 2013,2014 to USCIS then send the EXACT thing to NVC plus 2015.

I never sent I-864 to USCIS as it's not a requirement and hence never submitted tax returns or transcripts to USCIS. My query is related to Part 5 in I-864 EZ.

is your parents is only joint sponsor? if they have done it for all 3 years then you don't need worry about it.

I'm lost and confused on how you didn't have to submit any tax info at all.

I don't have any joint sponsor and was hoping that I don't have to use any with my income more than sufficient to satisfy their income requirement. Do you think I should do joint sponsor?

I-130 doesn't require any tax information. I am talking about submitting I-864 (affidavit of support) to NVC.

No I understand what you're saying. I'm just confused because I myself did the I-130. I had to submit my tax info with my I-864 Affidavit of Support when I sent my petition to USCIS. That's why I said the same tax info you sent them you suppose to send to NVC. The affidavit of support goes along with the petition that's how they learn if you can sponsor your spouse on your own without a co-sponsor or not. If you make enough money to sponsor your wife on your own you don't need a joint sponsor or Co-sponsor. Edited by Ms.F.Brown

I don't think I-864 is required to be sent with I-130 or at least I never sent it with my I-130, I also did it my self. I make more than enough for their guide line to sponsor my wife. I am just lost to if I should mark Yes or No for the question where it says did I file tax return for last 3 recent tax year, as I did file tax return for 2 years and only one is the 3rd year that I didn't file.

Mark yessss cause you did the last 2 yrs. Then just put those two tax info with the I-864 along with your employment letter for your job. But right before I did our petition. I actually called USCIS and asked them which forms had to be submitted to file for the I-130. The representative was the one that told me we had to do the affidavit of support as well. I did my petition myself as well. We didn't use no lawyer and has gotten blessed through this whole process.
