Hi JFH,

I am the petitioner. I am hoping that's not the case and some criminal may have same name as me but 6 months is a loooong time for additional background check. I keep praying everyday that the case gets approved today but my hope is decreasing day by day.

That's a very long time for background checks. Ours took 5 months and 13 days to approve. I knew it would take a long time to approve because my husband has a felony. I was even thinking we would be sent to Vermont where they do the enhanced checks (so I've heard).

Timeline in brief:

Married: September 27, 2014

I-130 filed: February 5, 2016

NOA1: February 8, 2016 Nebraska

NOA2: July 21, 2016

Interview: December 6, 2016 London

POE: December 19, 2016 Las Vegas

N-400 filed: September 30, 2019

Interview: March 22, 2021 Seattle

Oath: March 22, 2021 COVID-style same-day oath

Timeline

I am going to follow up with my congressman's office and also call USCIS tomorrow. I am planning to submit query with ombudsman, but since they only look at cases waiting longer than 7 months; I will wait till next month. I am really hoping that I don't have to go through this step. Any idea if ombudsman is any help?

Nebraska really does appear to have slowed down. I occasionally check the February 8 priority date (as that was ours) and there are still dozens of untouched files. I saw an approval last Friday for a January 24 file. I'm seeing more and more people going beyond the 6-month point.

Pregnancy is not usually a reason for expedite although a high-risk one may be. It's worth a shot. Get medical evidence from the doctor and try it. You never know.

Do you guys know if there is any logic behind who gets approved faster and vice versa? For example, faster for USC living overseas with spouse or the case has lots of evidence etc? How else can you explain cases from January being approved same time as April...

That is actually a great mystery in itself. How can there be multiple months being processed at the same time. I wonder what's the logic behind it.

Keep on lookout for your NOA2 you should be getting it soon. Check online status :P

I don't know if it's true or not but my case was in Nabraska as well but at local office at Omaha NE fild office. And was approved in 5 months so maybe they get case and get divided between offices around NE for processing and that could explain multiple months approval at same time

Want to Speed up NVC Process ?


Check Guides From Guide section for doccuments and list of stuff and follow this steps


Step 1 After USCIS NOA2 Gather all AOS / IV Package Documents In 3 weeks


Between USCIS Approving and NVC Case Number you have 2 to 3 weeks gather all AOS and IV Documents Get package ready.


Step 2 Obtain NVC Invoice and Case number.


​After 2 weeks of NOA2 Keep on Calling NVC every day to get case number And Invoice number


Step 3 Pay First Fee and DS261


After getting NVC Case Number and Invoice Number Log in to webpage Pay First Fee and Fill out DS261 Takes 24 to 38 Hr to get fee status paid.


Step 4 Conform Agent / Ds261 Over Phone and Sent out Documents


Once First fee turns Paid Online ( Usualy 24 to 48 hr) Call NVC And conform choice of agent over Phone If they won't keep on calling them Until someone will Or other fee won't be unlocked.Also Once you get Welcome letter on email Print out Document Checklist sheet And Sent in your documents to NVC


Step 5 Pay Other Fee and Fill out DS260 (Total time from DS 261 to here should be no longer then 15 days )


​Step 6 Conform Document delivery AT NVC And Ask them Processing Time..


Step 7 Check For CC ( Hopefully no REF )


Call them every other day 2 weeks from DS260 and Check status.. Also Check Online NVC Page If you have 3 N/A your case Complete! Congratulation you are almost done.


Step 8 48 Hr After CC Conformation Call NVC For appointment for interview


Congratulation On your NVC CC AND Good Luck with Interview

We are constantly told the cases are actioned in the order in which they were received. We know that is simply not true from the member data here.

Philippines beneficiaries are almost always fast-tracked. Apparently it's because of the danger there from a typhoon three years ago but with the terrorism in mainland Europe right now arguably the lives of the French, Belgians and Germans are currently more at risk but I see no fast-tracking for them. So it's all political.

In the past, couples where the USC was living overseas with the foreign spouse were processed quicker but that doesn't seem to be always the case anymore. Sometimes, but not as much as before.

Ours took 164 days. 5 months and 13 days. The case directly next to ours took just under 4 months. I know ours would have involved more in-depth background checks because my husband has a felony (he's the USC) and they want to be sure it's not something on their blacklist. But apart from that our case was, I thought, very simple. All documents in English. Got married in the USA. No kids involved. No overstays, deportations or denials. Lots of evidence of being together in person (over 40 trips made to see him over the past 4.5 years). But it still took over 5 months. I'm pretty sure we spent 90% of that time on a shelf gathering dust.

I would agree. I don't think they ever processed files in the order they receive, as they claim. our files may be just sitting on someone's desk or on shelf waiting and waiting.

What or who ombudsman?

They are part of homeland security who supposedly help with pending cases with USCIS. I am not sure if this actually works but if I don't hear anything in 34 days ( as told by Tier 2 officer today) than I am going to try requesting their assistance. Here is the link for your reference:

After reading about the long delay in Nebraska.. I was thinking about visiting her for couple months December-February. Was waiting until October for the five months to expire. Since this doesn't look hopeful. Guess I'll be taking some vacation time.

Funny thing happened today. I got push notification through USCIS app that my case was approved but when I went in the app, the case was NOT actually approved!!!!! I have a feeling that someone finally touch my file but this notification was after 6:00pm local time. So I am worrying that hopefully they are not preparing my file to be transferred. I would break all my hopes if my file gets transferred after waiting for more than 6 long months....

I checked my app which showed I'm approved but it didn't show on there til 5th August my time (a day ahead over here in NZ) and I was approved 3rd August. Might just take time to update.

PS: it took til the 8th August to get my email notification from them
