ALL Nebraska I-130 Filers

Just wondering....is there any evidence of Nebraska doing the rumoured mini-expedite for cases where the couple are both living abroad? Selfish question in my case, but my friend who did this a few months ago went through CSC, and his USCIS went rather quickly (3 months or so).

Unfortunately none that I've seen (in the same situation as you ... Filing from Australia). All the mini expedite for living abroad ones that I see appear to go from the lockbox straight to CSC. I'm a March 24th filer and still nothing so it looks like I'm in normal processing time ... Even married 3yrs, living abroad for 6, and a baby on the way.

Got married: 26th Sep 2013

I-130 Petition Process:

Sent petition to USCIS Chicago lockbox (via in-laws to put check in US$): 11 Mar, 2016

NOA1: 24 Mar, 2016 (email notification 30 Mar. Hardcopy 11 Apr)

Service Centre: NEBRASKA

NOA2: 3rd Aug 2016

Petition sent to NVC: 18th Aug 2016

Scan Date: 31st Jan 2017

Case Complete: 14th April 2017 (10 weeks 4 days)

Full expedite approved (bypass NVC to send file to embassy), however too late as I already had case complete 17th Apr 2017

Case arrived at Embassy: 21st April 2017

Am I overthinking this?

I've just looked at the numbers on the app close to ours. We all filed on the same date. Most of them still say "case was received" but some were RFE'd yesterday and today. None has been approved yet.

Could it be that hey do it like this...

Go through all the files in that batch. Put the ones that are going to be approved to one side ready to go to NVC. Pick out the ones where bits are missing and send RFEs. Once the RFES are in the mail they "bulk approve" the ones put to one side by updating the computer and parcel them up for the courier to take to New Hampshire to the NVC? Maybe a supervisor has to rubber stamp the approval before the system can be updated and the NOA2 go out? It just seems too much of a coincidence that for our batch the only ones that appear to have been touched have been sent RFEs. What are the chances? I'm thinking they must have checked all of them and already decided which ones to approve. Otherwise if they are touching random files here and there, statistically there would be some that were approved and a smaller number would have been RFEd. If they touch random files there would be a variety of outcomes. I just find it incredible that the ones they have touched have all had RFEs.

I think you're looking too far into it. However I do think they open it and check for the obvious such as missing forms, no evidence whatsoever etc when they open it to grab the check. Those seem to get their RFE letters very quick or rejection due to incorrect filing fee, form not signed etc very quick)

I honestly think that's as far as they check at that stage tho.

Form not signed or incorrect fee doesn't even get an RFE - it gets rejected the day the lockbox opens the envelope. It just seems odd to me that the batch I am watching - just a few days ahead of ours - has had a bunch of RFEs so far but no approvals apart from some that were approved within weeks of being received (possibly Filipino beneficiaries). It just seems very odd to me that if they have randomly selected some cases from that batch to process that they all coincidentally got RFEs. If you truly grabbed a random handful of petitions to process, you would have statistically more approvals in your hand than RFEs as only the minority of cases get an RFE.

JFH, your wrong in your comment. I got a RFE on my K-3 in January and they sent it back to me for a signature that I didn't put on it. They sent me a envelope to send it right back to them after I signed it. Our petition was not rejected because of it. The ppl who got RFEs probably got one because they need more proof of thier relationships or more financial evidence for the 864. Just be happy that you haven't gotten any so far.

Wow. That's a bit harsh. I should be thankful I haven't got an RFE? I may yet get one. Considering we have already been though this process for the UK and my husband was rejected, we have already waited long enough to be able to be together, I think.

My comment is not "wrong". I can see files from February that have "Case was rejected because I did not sign my form" as their status one day after the lock box received it.

JFH, I can't say that you are spot on, but I read your comment on Thursday late night and was hoping you were correct. On Thursday, I checked the app and the case before ours was RFE'd, and on Friday morning, ours and a few others around ours were approved. It's an anecdote, and maybe just a coincidence.

Hey all- hypothetical question. If one was to request an expedite and they did not approve it how would that effect your petition if it all? Thanks :)

It shouldn't affect it at all. I imagine it's possible that you'd get some ornery agent who sees you requested an expedite and decides to wreak vengeance upon you, but... I imagine they have measures in place to deflect that =)

That being said, someone does have to take time to review expedite requests. I'm not sure whether or not this person/people ALSO approve I-130's. What I'm saying is, if you KNOW you're not gonna get an expedite (you're not one of the reasons) it may be taking time away from approvals in general. That's about the only impact I can think of (and I can't even prove that).

I'm waiting for my NOA2 (march 28th POE). Just wondering if there's anything I can start working on this month, so that when the NOA2 does come I can get things sorted and back out to the NVC?

Find out how long it will take to get the police records, and if it take a month or so, you can request it now, you also can start collecting all the paper work for the affidavit of support and check all the form you will need to fill to make sure you have the information.

Let me see if I find a link were you can read about how to speed up the NVC process.
