864 and 864A question

Our circumstances:

I'm an unemployed USC. I want to sponsor my husband for a green card. He makes a good living (50k/year). We live together and have no children or other relatives who are part of this process.

It's still not clear to me if we fill out 864A. The instructions on the USCIS web site are confusing. Apparently the "intending immigrant can be considered part of the household" under our circumstances (married to each other and living together and no kids).

So which of the following is it:

1. I fill out the 864A.

2. He fills out the 864A.

3. We don't need an 864A.

I'm also confused about 864 section 6, whether I mark 11 or 12.

If your husband's income is from a legal source (i.e. he has employment authorisation) and will continue from the same source after his green card is approved, then his income can be included on your I-864 (under Part 6, Question 6).

In that circumstance you would submit only a single I-864.
