Answering a few replies.. I will say the Philippines is a wonderful culture and we met through friends of friends on Facebook. I knew her supervisor in the states who used to be her boss in the Philippines. I am currently in Arizona right now about to file the papers for.divorce. My lawyer said it would keep me out of jail if I did diversion because they could prosecute even with no injuries.

Why did I go.through with the K1 is because I was stupid for one and two try to.believe the best.usually until it's too late. I appreciate all the help. I really hate putting this out there. I want to say that I don't care what she does. I'm not out to get her deported I just want my life back. My heart was broken and that's the worst part of this.

And I wanted to add that I honestly lost all hope and faith in the justice system.. And now I can't even look at cop shows on TV it causes flashbacks. I never go anywhere out alone anymore. I was accepted for diversion 12 weeks. After I finish that and I'm divorced and.I submit the withdrawal then what's next? If they don't.accept the withdrawal how can I protect myself?

IMO, it is some admittance of guilt, and you'll go through a rehabilitation program.

If you never laid hands on her, then it makes sense to fight the charges in court, you being present with the judge and a lawyer.

First...make that infopass appointment, yesterday. Second, go speak to a lawyer, but also inform yourself on the whole DV, restraining order process. If the lawyer appears to be ignoring your evidence, information find another one. If your lawyer does not ask you questions on the green card, residency motive and understands the implications...secure another lawyer. Third and this is an assumption since you do not mention any restraining order, it is very hard for a respondent to have the order denied, but not impossible. The MOTIVE to claim abuse for residency, has to be CLEARLY, concisely presented to the judge at the hearing as if s/he knows NOTHING about visas. immigrants, fraud.

Last, you WILL have the antagonists, nosy replies to your thread(such is a conversation on the web), DON'T waste your time explaining yourself to those that appear to be trying to make you spill your whole life on the web. I wish you the best!

There are distinct differences between the criminal justice system and the application of western justice in terms of immigration benefits folks. If she goes the route of I-360 you have no hope for true justice. It is a manufactured system of protection based on loose application of the terminology "extreme cruelty" based on a vague evidence trail supporting physical and mental abuse.

Fight your criminal charge if you can afford to. I agree don't give in to diversion as an admission of guilt. Get divorced and try to protect your ASSets as much as you can, and for what little help it will do at least turn in hard evidence of any fraud to USCIS.

Like I said, poor fella, join the club.

It is immigration terrorism and nothing short of it.

KEEP your head up, even if your heart, other emotions are down at times, it is natural. You know what happened, in the end you WILL get ahead, hopefully sooner than later and add another experience to your life you may learn from.
