My story is same like yours, my father also naturalized last year and i gt stuck in this long queue. Kindly, consult a lawyer for this help, who knows better about this law. Do let us know if any developments take place in your case regarding the conversion from F1 to F2B, and be in touch through this web portal. Thanks.

Does this also apply to applicants from other countries like India, to be able to move from F1 to F2B. Has anyone done or heard this change done by someone from F1 to F2B, do share the process and time it will take to move.

As there was no prediction of future months in the June Visa Bulletin, unlike the March 2013 Visa Bulletin which predicted F1 movement to be between 2 - 4 weeks. I am not sure if that trend will continue or the trend for the next quarter is haphazard.

But going by the last years good Movement around July Aug Sept was average 49 days, a lay man guessing by previous year data that this July, Aug, Sept PD movements will be a little bit slow with average 5 - 6 weeks (35-42days). But yes there are many other factors that might not be same this year like in 2013, so this is just my prediction.

Hopefully some people this time around should start getting the ILs in this week itself. Any ILs received or any other guesses on the F1 situation ?

This time the list is long, we have many applicants who will be covered if it moves till 08th April which I am pretty confident about its worst movement.

Does anyone knows what are the chances to get study visa while waiting for immigrant number, I know its not easy but still??

I mean what kinda proofs an applicant has to show to make them believe and issue a visa. I have seen such F1 and F2b cases who did study and converted to H1B later when they gotta job and eventually got AOS for their cases and never returned back their home land.

But the Law is equal for all, here its not referring about the per country limit cap where Mexico and phillipines have seen such waiting times.

Right now, they are treating F1 rest of the world worst than ever. Waiting times are shooting up & already touched a 7.5 years waiting mark and soon it might cross 8 years too, who knows.

Concerned law is sectioned under CSPA regardless to any foreign country. I think we need to search out an alternative soon, it becomes a situation like when you join a queue to buy a train ticket and hopping into the smallest one to save time but soon you realize that the queue which you have left before got smaller and consuming faster than the new one.

Personally, I doubt on this current speed of F2b, as history already proven several times in last decade's data that the faster you run ahead more are the chances to face retrogression, which we have already suffered and faced back in year 2011. But, if this F2B retains its speed for the next 6 months like this then I must google the best lawyer in california for this conversion for sure.

Hi puru444, I believe it is possible for you to get a study visa, all you need to show is that you have strong ties to your country and that you don't intend to immigrate.

Wrong, Elsie. The fact that he has a pending immigrant visa being processed by NVC belies any proof of strong ties to home country. I'm speaking from experience.

Harrolds Are you saying that because he has a pending immigrant application that he cannot apply and get a non immigrant visa? That is untrue. all he needs to show to them is that he is not going to immigrate just yet, that he just wants to go and study for now and that once his immigrant application is ready to be completed, he will go back home and complete the process. He needs to really convince the consular officer.

Yes people can apply for a student visa, even though they have their Immigrant visa petition in process. I have seen one of my friend who got the visa whose FB1 petition was in process, however he had about 5-6 years for his PD to be current when he got the student visa.

As per my knowledge the visa prospects will be good if the person shows intent that he is serious about excelling in his field by selecting a good university I20 and other good academics records, and not trying to go to some below average college/univ just for the heck of it. Apart from that fair enough ties with the home country, Finances/Loan for the stay in US etc is common for all the F1 applicants.

Mcqueen, what is your PD date? It is interesting that you did not get the standard response, which goes something like, "We are currently processing 08 march 2007".

I called them, they said I should call back next week. Fingers crossed...
