Please someone answer my question asap. My sister is a derivative beneficiary and wants to apply for US tourist visa. She is on a work permit in Canada and wants to know whether the answer to question " Have you or anyone else on your behalf applied for an immigration petition?" should be yes or no. She has never filed any petition on her own and the current petition is filed on my mothers's behalf. So what should be the answer to the question?

The answer should be "YES" .

Wait time for f4 would be decrease to 7-8 years...

I think wait time will increase because 2.5 million approved petitions in NVC waiting for visa number in F4 category. Total visa quota for F4 is 65000 a year. so in 10 years only 650,000 visas will be issued. it means wait time will increase in future.

Even if we reduce 50% people from 2.5 million approved petitions due to age out and other reasons. than still1.25 million petitions. It means atleast 20 years wait in future.

So how can u say that wait time will reduce ????????????

Yes, Jolly786 is right.

This concerned Executive Order's agendas are following:

1. Additional 800,000 Numbers: They are planning to pour down some 800,000 numbers to clear the huge backlog that occurs in all categories right now. This figure will add up in EB 114,000 + FB 226,000 numbers of a given fiscal year. This fix will be temporary or just for once, it wont be happen in future because its just a trial to clear out the backlog in immediate crisis. Right now, total numbers are 340,000 including both categories, if additional 800,000 will add to these then the total number for year 2015 will be 340,000 + 800,000 = 1,140,000 (One Million One hundred & forty thousand)!!! Do the math and distribute these numbers among all categories according to their proportions. I think every category will receive almost 3 times more than normal.

2. Cases count regardless the Derivative Beneficiaries count: The basic problem of F4, F3 and EB categories are: their numbers of visas allocating to derivative beneficiaries. For instance, in F4 the quota has been sanctioned for a given fiscal year is 64,000 numbers but all these numbers consumed in this manner: Principal Beneficiary (1) + Derivative Beneficiaries (Spouse + Children, 3) at least 3 numbers will be consumed at any given situation or we can say that on an average lets take it 3 counts per case. In this way, right now just 21,000 approx. cases move per year (64/3) whereas if they fix this rule and count per CASE and not PERSONS will genuinely clear 64,000 cases regardless the total number of beneficiaries in an year. Charles Oppenheim said on this that if this fix wil be regulated then all the EB categories becomes Current immediately and FBs will be accelerated too and waiting times will be reduced eventually.

Now, back to your concerns of 2.5 million approved petitions. Those petitions are not from rest of the world. Majorly, about more than half are petitioned by Mexico and Philippines alone, they are already suffering with more than 20 years waiting times in F4 due to per country cap limit which is actually saving our asses otherwise rest of the world too suffered with longer years than of now. I hope, this per country limit cap has cleared your doubt now, you were not considering this point in your calculations above.

Try to recalculate the movements with the respect of above given 2 points, you will see the great movements in near future if these will really happen then.

So that means petitions with upto 2006 PD for the rest of world

will immediately get current ???????????????????

In existing circumstances under current rules and regulations with all those fixed prescribed quota and limit cap etc etc.

2006 in F4 sounds pretty impossible, but since we have already discussed the concerned issues and outcomes of these planning agendas might get turned into reality. Who knows the dates will fly up to 2006 or 07 or 05. But whatever will happen will definitely be positive in any aspect which speed up this dead process like from 512 kbps to 10 mbps :P:P

My PD is May 2014 and I-130 is not approved yet. Whats your take in this case? Thanks

I am also continuously visiting US despite of petition filed on my behalf. It also doesn't matter whether petition is approved or not. Visa Officer can refuse visa on other circumstances. This alone won't be a reason to refuse you a visit to USA.

As I mentioned earlier, its unlikely that there would be a discrimination between counting green cards for EB and FB petitions.

This was later confirmed by Carl Shusterman as well. I think that we family based beneficiaries may get lucky that due to pressure by corporations for employees, we may get the benefit of the executive order for e.g., Green Card counting rule?

Fingers crossed, next two weeks will be exciting! Spending your life with the family, nothing like it!!!!
