Almost 2,25,000 F4 applications are pending in India.

If we calculate 10,000 applications accepted per year than the waiting time is more than 22 years

i am going to be 22 this november...and i have just completed my bachelors...and now waiting for my pd to get current... pd is 1 November 2002...

In the meanwhile can i do job here in india ??

Or else can i apply for student visa and go to usa for masters and then when my pd gets current, i ll attend my visa interview for immigration visa... ??

Is there any risk in both cases ??

Because someone told me that i cant do job till i receive immigration visa...because i must be considered as a child though i am above 21...

and i m not sure that if i go to usa on student visa, then will i be eligible for my immigration visa when pd gets current...

If someone can guide me through this..please clear my doubts... :/

Yes, You can. You are an Indian National after all and will be remain for next 6 years at least when you will be in US. Our country is so flexible that there is no such hard and tough rules for immigration and work permits like western countries do in their homeland, instead of that our nation actually entertains every refugee and illegal immigrants from bangladesh, nepal, bhutan etc. Then what stops you to work ...

You can go to US for education purpose, since you are a derivative beneficiary therefore it won't be too hard to get you that. But, that would cost you much higher as an international student whereas you can save by continue your education after year or so when you arrive there on immigrant visa. You will enjoy many benefits like sponsoring your education by your own by applying loans under FAFSA scheme.

First of all, you will not be allowed to attend your interview without Principal beneficiary, if you are in US already on non-immigrant visa and waiting for your immigrant number as a derivative beneficiary, I doubt that they would have call you on interview for Adjustment of Status. Since you are a derivative beneficiary you always accompanied with the principal beneficiary till you enter the US on your first trip.

Case1: Suppose you gt education visa i.e. a non-immigrant one and your family joins you later on when they enter the US on immigrant visa. How they suppose to convince the immigrant officer at embassy or consulate during their interview that where their one child is and why he/she is not present during the interview?? (Take a legal advice on this, this one seems a very complicated scenario)

Case2: If you join your parents to attend the interview, everything will be smoothly done and you will go there and apply in your interested course with less fees and enjoy other benefits as well. In this way, you will avoid many problems which you may have to face in case 1.

Yes, someone told you the half truth. Non-immigrant visa people may work but under H1b visa not under education F1 visa. An international student is allowed in certain cases to work to meet his/her personal expenses but they need a permission from authorities (university in this case) first and that will be too given to work on campus only for max to max 20 hours a week. Immigrant visa equipped you to work and live freely by your own wish.

because i must be considered as a child though i am above 21... Nothing deal with the child thing here, you wont be allowed to work because you will be on non-immigrant visa in given situation. There is no such age cap for working in US. An American LPRs and Citizens can work right from their teenage, therefore if you land there on immigrant visa you will be free to work, study, drive etc. from the very next day when you get your SSN and greencard in your hands. You are already a grown up person right now, dont get confused with this Child thing in this immigration language.

just called nvc regarding PD 23jan,2002....and operator told me that it will be current in OCT,VB........so it means OCT vb will be at least 1FEB,2002..........................

Dude, this F4 is really getting slow.

My date was 22 Jan 1996 and we gt current in June 2007.

It has moved only 6 years since then after consuming 7 years. Average is less than 1 per month ...

i doubt whether the operators are allowed to disclose the visa bulletin before it gets released...its impossible that an operator will disclose the visa bulletin 1-2 months before its release...infact there is a possibility that even the operator may not be knowing what will be the movement untill the visa bulletin gets released by the authority...

solve my problem.i attach screen shot of my DS 260 page.

why my Ds260 Status is not avillable?

Are you above the age of 21? If yes then that is the reason.Only the children under the age of 21 years can fill DS260 along with the beneficiary. If you are not yet 21, Call NVC.
