Now we are not eligible for CSPA?

CSPA IS CLOSED FOR F3 and f4? When this law made. Is that 100%. It's not fair.its heart racking news. Plz plz rply to clear

On June 9, 2014, the Supreme Court of the United States in Scialabba v. DeOsorio, in a 5-4 decision, reversed the decision of the U.S. Court of Appeals for the 9th Circuit, and ruled that the “automatic conversion” clause of the Child Status Protection Act (CSPA) does not provide benefits to most immigrant families.

dnt wry..... this is for those whose CSPA age is over 21 years and they are not able to retain its parent Priority date........previously also F4 and F3 CSPA child out derivative also not able to retain its original priority date if their new petitions were filled under F2B.............

For those whose CSPA age is under 21 years they are still eligible under CSPA for F4 ..........

m 100% sure about this..........but still having doubt.................

Thanks for ur rply. Now my question if periority date is f4 31/July/2003. Case approved on 31/12/2009.My sisters date of birth is 15/07/1992. Is she under cpsa or not. If not what can do for her. Plz plz jolly rply. It's very important.thanks

she is covered under CSPA for sure....if her CSPA age is under 21 years during interview...........

when the U.S. citizen sister of Norma Uy sponsored her and her family for green cards in 1981, Norma’s daughter Ruth was 2-years-old.The petition for Norma Uy was approved the same day that it was filed. The reason that her daughter Ruth was over 21 years old when the priority date was reached.

Now,What if Norma had a sister who was sponsored on the same day, and the sister had a son born on the same day as Ruth? Suppose the government took 10 years to approve the petition. Under the Supreme Court’s decision, Ruth’s cousin would be able to subtract 10 years from his age when the priority date was reached, and unlike Ruth, he could immigrate with this family. :dancing: :joy:

What i observed is that the movement in FB category is half the movement that took place last month.F1 moved by 2 weeks last month and this time it moved by 1 week.F2B moved by 2 months last month and this time it moved by only 1 month. F3 showed a one month movement last month while this time its 2 weeks..What could be the reason? Moreover they have not given any prediction about future visa availability..What would happen?

visa quota over for family immigration for this fiscal year!
