hi friends..our case is currently at nvc. I have a sister who is eligible for visa. She lives in Canada and wants to immigrate with us to USA. Is it possible that she appears for the interview separately at US consulate Canada or she has to come to her home country to appear for the interview with us?

There is only one AOS. IF they are asking for DS260 that means they have AOS.

That is what the problem is..we have never sent AOS nor have we received any form except a cover sheet stating that the next step for petitioner is to establish financial support..my aunt was telling me that they will receive AOS form from visa office but i am doubtful whether they have to download it on their own ..what exactly does happen in a normal process?

This is what happens

you get change of agent letter(COA), AOS, pays $88, sends financial support document, gets IV fee bill, fill out DS260 form, sends civic document, gets interview letter, gets visa and come to USA.

BIG SET BACK for derivative child's under F3 and F4................

When Is It Possible to Retain a Priority Date for an Aged-Out Derivative Beneficiary ?

Only F2a petitions can automatically converted into F2b and no new petition is required. It retains its original priority dates.

but F3,F4 derivative beneficiary age out not able to retain their original priority date and parents need to file new separate petition under F2B........

Now we are not eligible for CSPA?

CSPA IS CLOSED FOR F3 and f4?

What is your source of information? Can you post a link?

CSPA IS CLOSED FOR F3 and f4?

What he described above does not affect CSPA eligible derivatives but age-out derivatives (Even after applying CSPA).

Hi sachin1,

Agreed as above. But my confusion is we had filled DS230 form with all civil documents in Jan2011.Case completed. Do we have to fill DS260 online again?

Now that the Supreme Court has ruled against immigrant families, Congressional action is necessary to restate in the most clear and unambiguous language possible the intent of CSPA’s automatic conversion clause.
