Timeline

I have overstayed in US for more than a year and returned back to India in Oct 2013. Got married in Dec 2013 and my husband is in US with H1 visa. I have attended the visa interview for H4 visa and the visa officer has suggested me to apply for the waiver. Can anyone let me know should I apply for I-601 or I-601a waiver? or how to relate my case with extreme hardship?

I601a is only filed if you are here in the United States, otherwise you would file the standard i601.

now i am in india, my husband working us, so i need file I-601?

for me i need apply 212 D3 wavier not a I601 waiver. I601 waiver only for USC/LPR, 212 D3 for non immigrant workers ,my husband working in us on H1. correct me if i am wrong.

5 or 6 months seems normal.
