That's a really tough situation you're in and I completely understand what you're saying. Our situation was similar. We had done a civil union in the U.S. We then moved to Germany and didn't do a Lebenspartnerschaft here. So both of us were considered single here in Germany. When we got married in Denmark, we showed them our German Meldebescheinigung, which listed both of us as single (which from a legal German standpoint we were at that point since we were not married and also didn't have a German Lebenspartnerschaft), so this worked for us.

What I would do in your case: Why don't you contact the Frederiksberg marriage office in Denmark? I have heard they are the easiest to deal with. Tell them your situation and see what they say. If this doesn't work, then your only other solution is the fiance visa route.

Hi Altito and GF1804,

Could you please let me know how long it took you to obtain the marriage certificate from either Washington or New York City? We are considering doing the same thing in the States but having a headache as we do not know where we can get the marriage certificate fast. We read from the city clerk websites and they are not that helpful. I understand from the DFC guideline that in order to file I-130 we also need to submit a marriage certificate. We are confused as some county cler offices said it takes from 10 days to 10 weeks to obtain such document. We are worried. Thank you for your advice in advance.

Hey Dinosaur2013,

I can't tell you about other states but in NY you apply for a marriage license 48 hours before your ceremony. We took two weeks out to visit our family in NY and get married, applied for our marriage license straight away on our first day (Day we got there). My husband's mother arranged the ceremony for us on Long Island for a Sunday afternoon in advance before we travelled to the U.S. (You apply and pay for license straight away in person and you are given the permission paperwork. The only stipulation is that you have to wait 48 hours before having the marriage officiated). The town clerk's office we went to in Huntington was AMAZING very friendly and wished us the best ceremony and congratulations.Remember you will both need your birth certificates and passports to get the licence.

After our ceremony (a week after our license was issued) we then posted off the officially stamped license and forms by the officiant back to the town clerks office, who will then issue a marriage license and certificate. They post it back to you (we used my Mother-in-laws NY address) it took 8-9 days to get back and then she recorded USPS to us in the UK (we were back home by then). You can apply for your I-130 with just a copy of it - we had a PDF of the certificate emailed to us my our Ma. She then posted the originals to us. You only need the original for your DCF interview.

Let me know if you need any help with anything else.

Best of luck!!

Hi GF1804

Thank you so much your response means a lot to us. We are now almost 80% to go to NY for this purpose. By the way, is your marriage certificate a "short" or "extended" certificate? TripAdvisor also mentions there is a tendency to obtain the marriage certificate right after the ceremony at the City Hall Cheppel. http://www.tripadvisor.com/ShowTopic-g60763-i5-k6032001-Getting_Married_in_NYC_A_Brief_Guide_For_Overseas_Visitors-New_York_City_New_York.html

You get two pieces of paper the license/certificate and a transcript or entry into the marriage register. You need BOTH for DCF here in London. Not sure what you guys will face in the Philippines.

If you can swing it take 2 weeks, apply for the license as soon as you land, have the ceremony 2 days later then get the license back from the town clerks office as soon as you can. Tell them what you need when you apply for the license they are bound to want to be helpful. You can always get the license posted to the U.S citizens parents or friend and they can scan and email you a copy then post you the original.

If it helps we didn't marry in Manhattan as it gets very busy as our family live on Long Island so we married there, slower and less bustle but we got everything responded to quickly they are also super friendly.

Let me know how it goes...

Hi again GF1804, Thanks a lot for taking time to reply my questions. In fact I also think of getting married in Long Island. Some of my close family members live in Garden City, Greenvale, Long Island, too. We might do the same with what you did. Will let you know how it goes if things go as planed.

Thanks a lot :)

In our case, we did everything by post from San Francisco one month in advance (we lived separated by then, my husband in SF and I in Madrid)

We sent the fee (check) along the marriage license notarized in April by mail to the county office in Seattle (King County). We called the courthouse and chose our wedding day according to our preferences and their availability

One day prior to our wedding we picked the license up, and went to the courthouse the next day for the ceremony.

We got married in May the 2nd and got the marriage certificate issued right away. After the ceremony we got several marriage certificates at the county offices to bring to Spain and for GC filing too.

Quite easy and quick!!!

Unfortunately, DCF is not available at the US embassy in Madrid. So that, we filed through Chicago Lockbox and now we are stuck in NSC. (Nebraska)

Nevertheless, we are living together in Madrid and there are no hurries so far....
