Interview date arranged but no I94?

We recently received a letter confirming our interview date for March 18th, and we're starting to put all our documentation together so we're ready. We've been reading lots of stories and interview experiences online so we know what to expect when the day arrives and we're a little concerned about my husbands lack of an I-94.

Just for a bit of a background, my husband entered the states from the UK on May 9th under VWP. He has a printed version of his ESTA, but our understanding is that I-94s were no longer issued as everything is electronic.

From what we can tell USCIS uses the I-94 as proof of lawful entry into the states. He has an entry stamp in his passport, printed tickets from his flight and this printed ESTA, so is that sufficient?

September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

Entry stamp in his passport will be okay. If he entered last may 9, I don't know if they had moved to electronic then. It might be online, I think they call it "waiver traveller." But before the electronics stuff, VWP travellers did not get I-94s (in years past they got I-94Ws but that was also phased out).

Hey, sorry for the delay in my reply.

So everything we have should be enough? We're just worried because from what we've read the only way to obtain an I94, if the online recovery site doesn't work, is to visit a CPB deferred inspection site. We wanna avoid this at the risk that my husband is taken into custody as he has by now massively overstayed on his VWP…US government organizations don't seem to work well together.

You have nothing to worry about. I too am adjusting from the VWP, the entry stamp in his passport is all he needs in place if the I-94. As stated above the Visa Waiver Program has never issued I94's as they are for Visa's , the VWP is not a visa, the old I94W which used to be issued for our purposes have been phased out. In our case a entry stamp is all that's needed. Good luck :)

05/05/2014 - ( day 75) - Text / E mail EAD mailed, Tracking number for USPS

05/06/2014 - ( day 76 ) - EAD arrived 2 days earlier than tracking info :)

05/09/2014 - ( day 79 ) - Applied for SSN

05/15/2014 - ( day 85 ) - SSN Arrived :)

05/19/2014 - ( day 89 ) - passed CA driving test

05/27/2014 - ( day 97 ) - CA driving License arrived :)

06/04/2014 - (day 105 ) - Case updated. Interview set for July 9th 2014

07/05/2014 - (day 136) - Interview date changed by field office ? New date July 17th

07/17/2014- (day 149) - Interview...Approved on the spot 10 year card !!!!!! :)

07/23/2014 - (day 154) - Welcome letter and I485 approval letter received

07/24/2014 - (day 156) - GREEN CARD IN HAND (10 year)
