Hello. My fiance will be coming to the US in a few months. We will then get married here and apply for her permanent residence. The problem is that her sister is getting married back in her home country, so I wanted to know is there a way for her to go back? Will she get her green card in time? What visa should I apply for her to go back after getting the green card? Any help would be appreciated. Thank you.

Highly unlikely. Even if you applied for AP=Advanced Parole immediately when she got here, it usually takes 3 months and going back for a wedding doesn't warrant an expedite.

There is no Visa to apply for after her Green card once she gets that you are free to travel. And know when you get married and send in your AOS (Adjustment of Status) application you are looking at 8 to 12 months to get approved.

Wouldn't it be better for her to just stay until sisters wedding than come to US? Just suggesting.

She is not going to make it to her sister's wedding.

It's unlikely that she will get AP in time. Would you risk buying the plane ticket without AP or wait for AP (if it comes in time by some miracle) and pay a lot for a ticket to fly in a few days?

Here is a suggestion. Get a civil marriage in July. File to adjust her as your wife. Have your wedding in September. Get AP by October (hopefully).

Thank you all for your responses. I guess she is not going to her sister's wedding. sad.png I can not have her stay there because we already paid booking fees for our wedding venue here for september.

Is there a reason you can't have a civil marriage in July to get the ball rolling so she can go th her sister's wedding? You can still have your wedding party in September.

This is exactly how you can do it and she can still go to the wedding and all will be good... Why add to the stress of her missing her sisters wedding!?!?!? Simple civil marriage file AOS and AP at the same time and you will have it for her trip home....

Based on the way you state "estimated day she comes to the US" makes me think she does not have the K-1 visa yet or even an interview date--it is hard to tell because you have no timelinetimeline.gif . If this is truly the case I see two options: 1) she gets the visa and checks the validity date to see if it is after her sister's wedding. If it is she hangs out in her home country and goes to her sister's wedding and then travels to the US and the two of you get married and begin the AOS process. 2) She has her interview, comes to the US immediately, you get married immediately and file for AOS with AP/EAD. Have the big get together in September. Hope and pray she gets her AP before her sister's wedding. If she does not get the AP in time she can then attend the wedding and the two of you start the whole process all over again or she does not attend her sister's wedding.

You might want to check the "immigration timelines" at the top of this site and check for GC processing times and AP processing times to see what the current trend is. Please keep in mind that these are actual processing times of those here on VJ, but the represent a very small sample size of the total number of cases being processed. Our AP took 46 days and the GC took 86 days, but that was back in 2011. I have seen the processing times coming down from the 90 days for AP and 180+ days for the GC, but the processing is very cyclical.
