HI All - I have a an urgent query - I am all set with my AOS forms but confused about 2 things:

1) Do I need to attach separate pictures for my EAD and Advance parole or 2 pictures al together.

2) Next question is that on Form I 765 - question 16 - I am here on K1 fiancé visa and got married within 90 days of my entry into US - do i need to mention this category as (a)(9) as quick tips says on VJ or (a)(6) which the instruction on forms I 765 says:

6. Family-Based Nonimmigrant Categories

  1. K-1 Nonimmigrant Fiance(e) of U.S. Citizen or K-2 Dependent--(a)(6). File Form I-765 if you are filing within 90 days from the date of entry. This EAD cannot be renewed. Any EAD application other than for a replacement must be based on your pending application for adjustment under ©(9).

  2. K-3 Nonimmigrant Spouse of U.S. Citizen or K-4 Dependent--(a)(9). File Form I-765 along with evidence of your admission such as copies of your Form I-94, passport, and K visa.

Yes, 2 photos for each for a total of 6.

You do what it says both on the VJ guide and the form instructions and put (c )(9 ).

7. EAD Applicants Who Have Filed for Adjustment of Status

A. Adjustment Applicant--(c )(9).
File your EAD application with a copy of the receipt notice or other evidence that your Form I-485, Application for Permanent Residence or Adjust Status, is pending. You may file Form I-765 together with your Form I-485.

(a )(6 ) is for a K-1 entrant that has not filed for AOS yet. If you use (a )(6 ), then it will expire when your I-94 does, and cannot be renewed. It is also possible they could send it back asking for the $380 form fee with that category. Only someone that has a pending I-485 can have the fee waived.

Thanks a lot - this forum is just excellent.

I have set up my application but have few queries regarding I 765 and I 131supporting documents. I am attaching 2 2 photographs with both the forms and my foreign passport copy as my id - I think that all I need to attach - is there any other thing which should go separately with these two forms ?

I just filed my I-485 together with AP and EAD. I did some research on this forum and this is what I included both with my I-131 and I-765:



- 2 passport photos


- copy of passport (bio page, visa page and stamp)


- copy of marriage certificate


- copy of NOA2 of I-129F


- copy of I-94.



Don't really know if that was necessary, but I'm trying to avoid any RFEs here. Knock on wood. Also I heard, that the I-485 gets separated and processed differently than the I-131 and I-765. Don't know whether this is true or not.
