Critique our NVC Package

Hi all,

10/10 filer here. Call me an optimist, but I think a transfer and approval for our I-130 may come between the end of March and the middle of April. I want to get all our NVC docs ready now. Below is a list of everything that will be included in our NVC packages. I feel like this whole process is a big maze that you have to figure out, mostly with the help of the kind people on this forum! I have found reading over other's cases to be very helpful. If you feel so inclined, please take a look at my AOS and IV packages and let me know if I've missed anything.

Notes on our situation: I am USC filing from overseas, currently living overseas with my spouse. I am a graduate student, my mom will be joint sponsor.

AOS Package:

1. Bar-coded cover sheet from payment portal

2. I-864 (sponsor)

a. Certified copy of birth certificate and photocopy of passport (information page only)

b. Tax Transcript

Note: I have no W-2 since my 2013 reported income was from a scholarship I received from my overseas school. Should I also include a copy of my 2555EZ (foreign earned income exclusion) to show my source of income, or would that be overkill? Or do I definitely not need to include any extra documents since I'll be using a tax transcript instead of return? Also, Part 5, my household size is 2. It's just me and my wife.

c. Evidence of United States Domicile cover letter explaining that I am living overseas temporarily as a student

i. Evidence: Copy of Student Visa (with English translation)

ii. Evidence: Letter of enrollment to show current student status

iii. Evidence: Proof of Permanent Address (recent bank statement showing address and account activity)

iv. Evidence: Certificate of Admission from Ph. D. program in the US

3. I-864 (joint sponsor)

a. Tax Transcript and W-2

Note: Joint sponsor files jointly with spouse (my dad). Am I correct that the non-sponsoring parent does not need to complete any forms? My mom's income is enough to cover the requirement. Do I need to include joint sponsor's W-2 to show which part of income is hers? Part 5, household size is 3. My mom, dad, and wife. (I'm not a dependent).

b. Photocopy of passport (information page only)

c. Employment letter to show current employment and salary

IV Package:

1. Bar-coded cover sheet from payment portal

2. Photocopy of applicant passport (information page only)

3. Original applicant birth certificate (and photocopy)

4. Two photos of applicant, name, date of birth and case number written on back.

5. Original marriage certificate (and photocopy)

6. Original police certificate

Both packages will be mailed together from overseas. Thank you very much for looking over my case and any feedback you have to offer.

Anyways, I wanted to clarify one thing: Since my mom's taxes are "married filing jointly" but she will be the only joint sponsor, filling out I-864, for part 6 13a,b,c (Sponsor's income and Employment), where it says "total income" will she write the amount from Line 16 of her W-2 for each year? It seems she cannot write the entire reported amount as it shows on the tax transcript, as some of that income is from my dad. Thanks again guys!

If only your mom is going to be the joint sponsor, then you will need to submit complete copies of the tax return forms (can't use transcripts) and her W2's that show only her income.

With regards to editing a post, from the time it is posted, you only have 5 minutes to make edits. You can make as many edits as you wish during that timeframe.

August 8, 2011: NVC received file
September 1, 2011: NVC case number assigned
September 2, 2011: AOS invoice received, OPTIN email for EP sent
September 7, 2011: Paid AOS bill (payment portal showed PAID on September 9, 2011)
September 8, 2011: OPTIN email accepted, GZO number assigned
September 10, 2011: Emailed AOS package
September 12, 2011: IV bill invoiced
September 13, 2011: Paid IV bill (payment portal showed PAID on September 14, 2011)
September 14, 2011: Emailed IV package
October 3, 2011: Emailed checklist response (checklist generated due to typo on Form DS-230)
October 6, 2011: Case complete at NVC
November 10, 2011: Interview - APPROVED!!!
December 7, 2011: POE - Sea-Tac Airport

September 17, 2013: Mailed I-751 to CSC

September 23, 2013: Received NOA1 in mail (receipt date September 19th)

October 16, 2013: Biometrics Appointment

January 28, 2014: Production of new Green Card ordered

February 3, 2014: New Green Card received; done with USCIS until fall of 2023*

December 18, 2023:  Filed I-90 to renew Green Card

December 21, 2023:  Production of new Green Card ordered - will be seeing USCIS again every 10 years for renewal

thanks for your reply. could you please point me to some literature on this? i had called NVC about it, and they said since my parents do e-filing, that a printout of the return cannot be used (i didn't ask why exactly,but i assume because they're unsigned).

I didn't know about the e-filing thing. I would call the NVC back and ask for an explanation. Another thing you can do to save hassle is just have the other spouse complete an I-864A.
